2nd offense
Got a DUI a few years after finishing my monitoring contract, was offered the same contract to keep it off my nursing license but declined. Went before the board and got the evaluation and all that. Ended up with 1 year of probation and drug tests with none of the monitoring stipulations. It's not fun having a hit on your license but it hasn't ever stopped me from getting a job. Been sober since then. The DUI was sealed/expunged but will always show up on my license
- Anyone ever go into rehab voluntarily? How do you navigate BON/Work?

I promise you won't lose your license, a dui is a dui. You'll probably end up with some type of probation but you will NOT lose your licensee.

Difference between someone driving drunk and someone who's ride left them so you slept in your car and got a knock on your window, but the law doesn't see it that way

Hey! I had a DUI a few years back and did it all without a lawyer. I'll tell you how it went in my state! I get a letter offering me to go into their rehab program, If I do the board will never hear about this but I'd be stuck with their godawful stipulations. I called and declined. Then I got another letter from the investigator setting a date and time to talk on the phone. I was like ya I regret what I did yadda yadda. fast forward to my initial hearing and their attorney tore me a new one. I said look I'm sorry for my actions, I regret it completely, blah blah. They said well do you want to do the rehab program. I said fuuuuck no. They talked in an executive session and said aight here's the deal. Drug testing and drug evaluation and then we'll meet again and review the evaluation. had my eval and was like no I'm not an alcoholic, yes I drank, yes I understood I endangered people, yadda yadda. In the end she recommended drug screens for 1 year along with weekly AA. fast forward a couple months and I get my hearing. Of course their attorney acted like I burned down an orphanage but I stood my ground and said look, you cleared this lady to do evaluations, this is what she said I need. I agree to it. Anyways, they accepted it and I finished a few months ago. It literally didn't affect my career at all. I ended up working at a FEDERAL hospital making way more than before. In the end, the only people who care about a DUI is the BON. Even then I'm convinced they probably don't care but are obligated since they protect the public or whatever the claim to be ***ing doing. anyways, just wanted to share my story. Tons of people get DUIs

Ya a few times. "O" is other and is usually specific to the program. They may be testing for Etg, Klonopin, Kratom, who knows

If your AM really was that cool and nice about it then it may not hurt to ask if they're reporting you. When I got my DUI in my state they sent me a letter saying if I volunteered to go into the rehab program then the investigator wouldn't get involved. I ended up fighting it and got a year probation and a hit on my license. That hasn't stopped me with getting jobs. Worse case the board will set a date for a hearing and you'll be told to get a stupid drug evaluation and then they set another date to review it.

Ya, twice with my Klonopin that they knew I was taking. It would only be an issue if you were prescribed it but were not authorized by the program to take it, or you didn't notify your case manager about the medication If it's OK to take, and they know, you're fine

So long story short I got a DUI back in 2020. I was disciplined with probation which consisted of random drug screens. I successfully finished that AND successfully finish my court probation. I just spoke with my lawyer and the charge has been completely sealed, as in the court document I received said I am legally allowed to say no to any questions regarding this misdemeanor. So my question is this, I won't lie on the application, but how would a non compact state look at my public nursing license discipline but also see there is no trace of legal action against me?

You can request FMLA on personal ground and don't you dare tell them what's going on. I've heard a few stories here where the rehab place reports you, which is beyond ridiculous. I'd say lie and tell them you're an electrician or plumber or anything BUT a nurse. They may or may not look you up to confirm that story
