How long before a non-NCLEX passer gets her interim permit? What if she failed the NCLEX and she's already working as a nurse?

the interim permit will be sent following the BON's approval for your exam aplication and especially when you requested and paid for it. they will only issue IP for first time test takers. doesnt matter even if you are nursing in foreign land for 20 years as long as it is your first time to take nclex, you are still eligible to have one.
on the other hand, once you have your IP, you are allowed to work and some agencies and hospitals will actually hire you as a newly grad nurse or so. but once you take the test and fail, IP will automatically become null and void and it is your reponsibility to inform your superiors about it or else it will be a legal problem. other companies do have hearts. they let their Nurse stay even if they fail and give them few more chances. others become demoted to cna...its a case to case basis/hospital/manager.

A prospective nurse only gets the IP when they have been approved to take the NCLEX exam. It means that they have met all requirements other than writing of that exam.
Actually once the exam is written, the IP fails to exist. At least that is the premise of it.
Meaning that if you pass the exam, you get a license and are now an RN, and if you do not, then the IP no longer exists and the nurse cannot practice as one in the US. To continue to practice on the non-existant IP, and when they knowingly know that they did not pass the exam actually can open them up to criminal proscecution as it would be considered practicing without a license. And it is just that.

The facility may permit them to stay, but it will not be in the role of an RN, or they can be fined just like the nurse. Having a nurse that does not have a verifiable license or IP.
It is not open for a second chance with the BRN when practicing in the nursing role without a valid license. In any way shape or form.
