I signed, am I legally binded?

I have signed a contract to an agency actually law firm based in the US. At first they email and text me but after 2 weeks they stopped. I started doubting them because they are not assisting me with my application. And when i do text them to ask what to do or what to write on the application they dont reply. The only thing they did for me was to give me 1 fingerprint card which later on i found out that it was given for free when i request for it in the state i am applying for. After 3 months my fingerprint card and the check was sent back to me by my state with a note that i have to submit 2 fingerprint cards. I contacted my agency after that demanding them to give me a copy of the contract that i signed. They did not give me one but insted they bring another copy of the same contract but not singed. They told me they forgot the singed one meaning they want me to sign again which i didnt. Do you think im still legally bind to them? ooppsss... additinal, the contract that i signed was not notarized and i dont see any of them sign plus the witnesses on the contract are my fellow contract signers. Please help me! I want to look for other agency but im afraid. I dont want to be black listed. In advance thank you for your help and taking time to read my sentiments although I know you would think how stupid of me.

You would not be black-listed, and you also need to report this so-called agency to the US Embassy in Manila because they are not taking any responsibility for what they need to do.

And what did you even know about them before you signed with them?

And they are legally bound to give you a copy of the agreement that you signed.

It was just refered to us by a co-board passer during the peak of the leakage controversy last 2006.

Which agency is this? Please send it to me in a pm. Now that you have mentioned what you just did, I have a sneaky suspicion of who it is.

But let this be a reminder to all of you out there, a contract is a legally binding document, and you should check it out completely, do not rely on what a friend tells you.

I also signed a contract with an agency last 2005. They have not paid for any of my exams nor for my visascreen but have given me advises on how to obtain them. It says on the contract that all other expenses associated with my greencard application will be shouldered by the agency and those that I have paid for myself will be reimbursed after I get the greencard and hospital assignment. However, last Dec, they sent me a letter saying that due to the retrogression, they will no longer be paying for my greencard application (which they have not started filing at all!) and that I would be paying the legal fees and all. Am I still binded to the contract that I've signed when thay are not fulfilling any of their commitments listed on the contract? I tried to email them for a confirmation that I'm no longer legally bound to the contract but all I got was a reply that I need to wait till the retrogression is lifted. This is really unfair for me because I need to get started at least on my I-140 application....

They also told us that they will assist us in filling for NCLEX which they didn't do. I shoulder all the expenses because they told me that it will be reinversed 30 days after I start working in Texas. (now that im typing it i'm realizing how stupid i am).

Hi StuckInMNL! I think i know that agency. I received similar letter like yours... Last December.. Good thing I didn't signed up any contract from them. But I signed up to another NY base agency which I later find out that they have a pending case going on... One day, I bumped into this site and asked for help. People here are very helpful. Especially to Lawrence and Suzanne. :) Thank you very much.... :) Try ask help from them. They know alot of things about contract, immigration and etc. :)

They are not meeting their obligation to you as part of the contract that was signed, things need to be done in a timely manner, and they have not lived up to what they stated that they would. They need to cancel the contract. You do not need to wait for them, that is a bunch of garbage. They do not own you.

You do not file for the NCLEX, you apply for licensure to a state. They are completely two different things.

And most agencies that are paying will not do anything until they really have to. And with the retrogression on right now, most will not do what they are supposed to be doing. And that is utterly crazy, as the ones that get things done now, will be first in line when the new visas are available, whenever that is.

That's what I thought, too! I figured that this is a perfect opportunity for me not to go the agency route but the thing is, I'm having difficulty getting them to cancel the contract. :scrying:
