Green card question

Hi all

I was wondering how the process of applying for a green card goes for an F1 student. I know I need a visa screen, an employee to sponsor my petition and physical exam but what I really want to know is does someone who has an F1 visa who graduated from a nursing school in the US take precedence over someone who was educated abroad. How do they issue these greencards. Is it first come first serve or is there certain criteria. Should they not select graduates from US schools first over someone that was educated in another country.

Nope, it all depends on your priority date

You do not get to go to the head of the line if you graduated from the US. No extra points for that. And why should they select someone that graduated from the US over a foreign-trained nurse? If you think about it, many of the foreign nurses in the US that graduated from school here, went to a two year program; from overseas, they are coming in with a BSN. The two year program overseas does not even qualify for immigration to the US.

hi everyone..does anybody know the steps in obtaining a green card?i am a nurse in the philippines..i just passed the IELTS and will apply for NCLEX in vermont next month..i want to work in CA though..i know that in order to have a green card, i need to have an employer in CA to petition me..but i dont know how or where to find an employer in CA. i dont even have an idea of the things that the employer might require me to pass..please help..

Please go to the Primer at the top of the page and read that. You do not apply for the green card, it must be done by an employer for you........

You need to pass the NCLEX exam, as well as the English exams. Get those done first, there is not one thing that anyone can do until you do that.

yeah but im just a lil curious..so i can estimate or plan a time frame or schedule for the things to be done like visa screening and green card stuffs.

thanks anyway for your prompt reply..

Hi,

I am just wondering

1) How long does your employer will give you a green card once you arrive in the US?

2) Can a family member who is a dependent with your greencard can go home to the Phil. even though his/her passport is stamped with only I-551 without any greencard?

3) Do the family member should apply for a Advance Parole (I-131) form?

4) If you and your family have received an immigrant visa from the embassy of origin and given 6 mos. allowance to go to the US, could it be possible for the nurse recruit to go first then after 4-5 mos. your family would follow?

Hope someone could reply with my inquiry. Thank You

Visa Screen will not be processed until you pass the NCLEX or CGFNS exam, as well as the Englishe exams. Green card is hadnled by an employer and immigration attorney, and is usually about 12 to 18 months for those from the Philippines from the time that the I-140 is submitted until they have their visa in hand and are ready to travel.

How you do things is up to you, but without having one of the nursing exams completed, there is not one thing that can be done to start the process for you as far as immigration.

The US Government will send you the actual green card in the mail, it does not come from your employer, unless you have it mailed to their address.

It normally arrives within a few weeks of arriving in the US.

Advanced Parole is for the Adustment of Status nurses, the green card should follow before anyone woudl want to go home.

And yes, the nurse can go first and the family can follow, as long as they do it before the six months expires.

Hi suzanne4,

Thank you for the reply. So it means that once you have a green card you can go back and forth to US. But for how long would you stay outside US?

What ever you want, you just need to meet the minimum requirements to maintain the green card.

thank you suzanne!!Godbless!
