I've been a nurse in good standing in the state of MI for 12 years with no previous criminal history. Incredibly long story short, I was arrested and charged with 3 felony counts of resisting/obstructing an officer. I was intoxicated, injured and trying to refuse medical attention from EMS when the event occurred and don't even know what happened. I have a plea offer where the charges would be dismissed after a year of probation, or my attorney can try to talk about reducing the charges to some kind of misdemeanor. I just learned that I will have to report that to the state board after I accept the plea, even though it will be deferred and then dismissed. That pretty much means I will lose my nursing license, right? Has anyone been through a delayed sentence deferral program that can share their experience? I'm feeling pretty hopeless right now, like my world is ending over one night.

See my post from other thread re criminal convictions effecting license. Since you posted re intoxication, expect BON will request eval for alcoholism and may refer to nursing diversion program. You need a attorney with experience with BON to protect your license at all costs. Best wishes moving forward.

If you were not convicted you won't lose your license. You might get a referral to hprp and go on contract. Do what they say and you will be fine

Hello, I went through a similar situation. I plead guilty to a felly assault by force charge-that was later dismissed and expunged. I self-reported to the BON and I had to go through a lot to get my license back-but I also had a previous history of misdemeanor arrests. If I were you I would keep working with my attorney in an attempt to drop it before you plead. I would also check with the BON.

Thank you for your advice! I actually hired a healthcare attorney to assist my criminal attorney was able to get a different offer from the prosecutor to reduce the charges to 1 misdemeanor count of attempted R/O and drop the other 2 charges, but the charge will stay and not be dismissed. Later, I can apply to have it expunged, but it sounds like it doesn't really matter because it will be reported on my license forever anyway. The healthcare attorney said that the felony would be an automatic summary suspension but the misdemeanor is not an automatic suspension. My biggest concern now is where I will be able to find a job with this on my record. I will not be able to continue to work at my current job, once they find out about the conviction.
