Could use some help with an assignment

If you think a fellow nurse is drunk and do nothing about it you are just as responsible. The hospital always gets sued along with anybody else remotely connected.

2.B It is the pts information after all. Iwent through this when my kid was dx'd with a brain tumor. Anytime I wanted to see it a nurse would go through it with me step by step. I think this is so if I had any questions she could answer them or explain. And I also think because it is a legal document it can't leave their sight. What if I removed something? See what I mean.

3.I have no idea.The duties couldn't come from the mayor or govenor. What the hell do they know about it? Good question.

Hi, I'm new here, and I think it's great to have a forum like this! I am doing a take home exam and am having some problems with three of the questions, maybe someone out there has some brilliant insight!!

1. You (LPN) notice while listening to report that your co-worker seems intoxicated. Later in the day the co-worker makes an error in judgement and a pt. is injured: Who may be held responsible?

a. You (LPN) and the co-worker (LPN)

b. The hospital and the head nurse

c. The hospital and both LPNs

d. The LPN and the hospital

2. What is the right of the pt under the Freedom of Information and Protection of Privacy Act to see his/her pt. record/chart?

a. The pt can see record/chart regardless of his/her mental or physical health.

b. The pt. can ask nurse to review the record/chart at any time.

c. The pt can see the record/chart if it will not cause harm to the pt. or any other person.

I'm pretty sure it would be C; we're not supposed to give out diagnostic information. I can't find anything specific, though.

3. How are the legal duties and functions of the practical nurse determined in BC?

a. by the Gov't of Canada

b. by the Health Professions Act

I've already discarded two answers, but wouldn't the duties and functions be DETERMINED by the Gov't and DEFINED by the Act?? Or am I being too technical???

I could really use some insight, this is due tomorrow!!

I know that this is to late, but the answer from question 1 is A. You must report any behaviour that is inappropriate...under the influence of alcholol/drugs MUST be reported to the charge nurse.....nurses are a self regulating body and if we do not follow the proper channels and report poor behaviour then the Nursing Association will loose their right to self govern...We are unique...we can self govern so lets not loose this right. I think we all would not want to have a regulated healthcare worker endanger (by neglect or by error in judgment)one of our loved ones

Patients have the right to view their chart, but only with a Nurse or Dr. present.

Again in Ontario we are governed by the College of nurses ...but if a patient's life has been compromised we can be charged with a criminal offence under the Federal Law of Canada.

1. d, according to the texas state board of nursing, the LVN that is intoxicated is responsible for there actions and the hospital because the LVN is employed there.

2. A According to HIPPA and the patient's right act, the patient has the right to see any medical records unless deemed medically incapable.
