Hi, everyone. I am gonna breach contract with my angency, but there is one thing I am still confused.
2 years ago I signed the contract, and my agency applied the GC for me, but the problem is till now they haven't found me a job yet, now I have moved to other state with my family, but my agency want me to go back and work for them right now. I can't leave my family and go to other city, since I have't start the contract yet, do I need to pay them the breach fee ($25,000)? That is huge money, it is so unfair, can anybody help me? thanks a lot!

If you signed a contract then generally you have to honor whatever you signed. Issues I see if 2 years and they didn't find you a job how did you get your GC?

Do you in fact have a green card now with them, or are you still waiting for it? They are most definitely entitled to being reimbursed for any expenses occurred by them on your behalf.
And you did sign a legally binding contract with them, and if it has a cancellation clause in most cases it is your responsibility.
Please clear up these few questions, so one can give you a proper answer.
thank you guys, I am still waiting for my GC, haven't got yet. If I have already worked for them, I will definitely pay them, the problem is I have been waiting for 2 years, after I moved to other city, they just found me a job and want me to come back, that is so unfair.
They have nothing to do with the delay on your green card, that is out of their hands if the proper documentation was submitted from the beginning.
They do have the right to cancel your petition if they want, since they paid for it.
Not sure why you have waited two years for them to have a job for you, technically, your petition should have been cancelled by the US government long ago if there was no work for you, that is something that the agency is required to document for the government here.
Are you sure that things are even still pending for you at this time?
