workplace injury

Sometime ago I sustained a workplace injury and was on workers comp. Upon my return to work my restrictions weren't honored and I gave a resignation. Ultimately I felt I rather have my health than put myself in any kind of risk as I recovered. I am curious to know if I interview at different facility's and they call my old employer, can my old employer disclose the work related injury. Upon giving resignation I was finally granted an eligible for rehire, just because I didn't want my name tarnished.

Currently 6 months later, I am doing much better and no permanent damage or any sort of restriction, if I interview at a different facility and they call my old employer, can my old employer disclose it? I am so worried and don't want a injury to destroy a career in acute care.

Hi hopern84,

I have the same issue, I got a shoulder injury and my employer decided they don't want to accommodate my work load so I am at home recovering but also they still keeping me as an employee and for me to resign and break my contract is a lot of money. I have the same questions ... if they let me go and I can go looking for a job, are they allowed to inform other companies of my injury? And if my shoulder does not improve, what kind of nursing can I do if I am not able to use my shoulder?

I am very frustrated and discouraged right now because I love being an OR nurse and have been for 12 years and dod not know what to do if not nursing.

Hope someone has some insight in this matter.

Good luck!!!

This is a personal health issue. You have the same rights as any patient does. Your former employer may disclose that you resigned, but cannot give any detailed health related information. If you need more information I would contact OSHA.
