I have a friend who said he filed for adjustment of status since october 2006 and received all his approvals except for I-485. He said it's been showing since january that a request for evidence was mailed to his attorney, he contacted the attorney who immediately called the Tx Service center and they said they were resending another copy since he never received anything. They have waited for 2 more months and nothing in the mail and so he went to their office recently and they said they mailed it to the attorney and will not re-issue another copy. He said he is sure the attorney would not receive anything and be hiding from him. This same attorney had done this adgustment for 3 pple he know in his work place and everything went fine. And to his understanding, the attorney made sure everything including the visa screen, birth cert, physical exam and all were sent in at one time.
Question is, has anybody gone thru this kind of issue before as it is really frustrating. I'm aware of the retrogression which i told him about. He also said they had stated one time that he didn't pay for the finger print, yet they sent him a letter saying he should go for finger printing(he went). But his attorney also sent in the copy of the money order and they removed that (online) and now put this disturbing message. Has anyone gone thru this? ..Or going thru similar situation?

Service Centers are working with far fewer people right now. That will be playing a big role in things. If your friend signed documents that gives the attorney the right to represent him, then immigration will have all contact with the attorney only.
The other key thing is that he has an EAD, and has things in process, and can work. If hs just had his petition submitted in October, he is going to be waiting for the green card until they are available again. A visa number is not assigned when the petition is submitted for the I-140. And there already were no visas available then...........USCIS was kind enough to permit the petitions to be submitted until the end of October, not when they ran out of them.
Many people here have gotten RLEs. This is something that the attorney is going to need to work on, the information will not be given to your friend by immigration.
He said they usually send him every copy of each document that is sent to the attorney. Thanx Suzanne4. I think I'll tell him to let the attorney handle this more..afterall they collect very huge amount of money..:) He just prays that it gets settled before retrogression is lifted.
He has months before the earliest the retrogression will be lifted, not sure why he is concerned, he is able to work. One of the lucky ones.

I had a RFE and it was sorted within a couple of weeks but this was back in October 2005 when there wasnt retrogression to worry about.
Approval of the I-485 does not normally come when there is a retrogression in place. There have been some that are getting word that they have had approval in the past week or two and should be getting their green cards shortly.Not sure if your friend was included with this lot.
