first I-485 denied and filed second I-485 in US
hello, my first i-485 (concurrently with i-140 pursuant to schedule a) was filed validly since i was on h4. however, my first i-485 was denied one year after its filing (unable to provide visascreen certificate). i did not renew my h4. my second i-485 was filed almost immediately after the denial of my first i-485. i have been working on ead in us since (two on the first i-485, one from the second). i was told that my second i-485 was not filed properly, meaning i was not on nonimmigrant status at the time of second filing my i-485 and worst of all, 245(k) did not apply in my situation since the time when i was out of status was counted from the time when my h4 expired but not from the time the first i-485 was denied. is there an argument to make that the 180 days could be counted when the first i-485 was denied? if you have similar situation, please share it here. or if there is such a thread, please let me know. unfortunately, this situation arises from concurrent filing of i-140/485 and the difficulty of obtaining visascreen certificate. what is the solution to this? what is your way out? thanks.

hello, yes, i am still around. unfortunately i still have to struggle with the test. i appreciate inputs on scott's english success. anyone who took ielts in us has used scott's english success? i think that you need to speak american english when you take ielts in the us, however, scott's english test is in british english. probably scott's english success may be confusing when you prepare speaking part for a test in the us. in summary, i think that scott's english success may be helpful for listening, reading, and writing, but may not for speaking. thank you for sharing your experience and/or opinion with scott's english success.

RFE for VisaScreen
Well, thanks first for your consistent support. I am going to take TSE this September. Even I passed it the first time (one of my friends has taken 3 times TSE, 2 times of IELTS, how many times I have to take to pass it?), I would not be able to submit the certificate on time. The only argument (logical, I hope) is that TSE is to test the ability to communicate orally in English. I have sucessfully worked here in the US for a year or so and I have demonstrated that ability. I am not certain whether that 'waiver' is possible or not. Even my lawyer did not think so. You could say that to waive TSE is my wish which is remote like I said. Thanks. wbd

Hello, all, I would like to thank all for the kind information. I just got the notice today. It looks like it is hopeless since it states that no extension is granted! The letter has three options. 1. Submit all evidence. 2. Submit some or none and request a decision to be made. 3. Withdraw. Is it possible to waive TSE that is the only missing piece? The logic here is that I have worked here in US for more than a year and I have demonstrated my ability to communicate orally in English. This sounds like extremely remote. Best wishes, wbd

Hi, Thank you very much for your information. I would like to go on some details regarding your questions. 1. China does offer 4-year programs, but it did not around my time of schooling. I graduated in 1984. 2. CA accepted my credentials. I have been in US for 7 years and have accepted an offer as a RN here. 3. I am going to attend school in the US for a BSN soon. Regarding the equivalence of my eduction, even my lawyer did not make any comments. My lawyer did not and may not do anything about the visa screen and that might be the reason he did not say anything about it. Again, will my future BSN here help in my case if I obtain it before Visa Screen is needed? Thank you again and best wishes, Sincerely,

Any remedy if failed Visa Screen?
Dear all: I am going to start my Visa Screen. I would like to know what can be done if I did not pass the Visa Screen. For example, if CGFNS did not think my eduation is equivalent to that in the US. In that case, would it be possible for me to take some classes to remedy for that? Or does it help if I am going to get a degree in Nursing here in the US? But CGFNS is 'screening' my past education! I know I can take TOEFL as many times as possible, but I can not change the past! By the way, I have passed NCLEX and started my immigration procedure that requires Visa Screen. I have an Associate Degree from China. My concern is that would be an Associate Degree meet the educational requirement of Visa Screen? Please advise and thank you.
