? Getting fired

Specialties Geriatric

I'm 12 weeks pregnant with twins. I have had intermittent absences from work ( with MD notes). Now my MD wants to put me out for an extended period. My boss is mad, he has already asked me to switch to per-diem because of it, but I can't because I will lose my insurance. Is this medical leave something I could get fired for? I have been at this facility a month shy of a year and have had one call out prior to my pregnancy. Thanks!

depends on where you live i think and also if you're on good terms with your boss(es) before you leave. here you're pretty much only guaranteed a position, i don't think necessarily back on your unit, if you take the 12 week fmla AND you've been there at least a year. they don't have to hold your job for you if you're out past the 12 weeks. this is my understanding of fmla anyway. happened to 2 people on my unit, one was lucky to get her position back (she hadn't been there a year yet) and the other does not have her position anymore and she was there for YEARS. good luck though. i think if you have to go out on maternity complication leave, that should be in it's own set of rules, but i don't think that is how it works :(

Thanks for your response. I'm from MA and according to them I don't qualify for FMLA. I figured that would be the answer. Thank you

Have you worked for the company for at least 1000hrs? (which is about 6 months of working 40hr weeks) that is one of the minimum requirements for federal FMLA.
