Applying for NCLEX

Hi everyone. I currently have an unresolved Public Intoxication charge on my record but I am supposed to be applying for the NCLEX now. I was in the car and wasn't acting a fool or putting myself/anyone in danger. Should I wait and see what happens in court or go ahead and apply? Thank you in advance!
