You should check with the local courts and ensure that your record is accurate and then obtain a copy. You might consider writing a small narrative that describes the situation and include a certified copy of your record with it.

I'm not sure but here in California your record might preclude you from holding a certification from the State. You should certainly contact your local agency and be sure of the rules in FL.

Unfortunately, particularly in the present economic climate, even a misdemeanor may be enough to cause employers to give you a pass when looking a candidates.

All CNA training programs are required to have a background check before accepting students into the program, this is a new policy. If you got your certification, no one is going to take it from you for something that happened 5 years ago.

If a felony is coming up on your background check, then you may want to consider speaking with a staffing coordinator when you go to apply places so that you can explain your situation.

Speak to an attorney to get it expunged. That might be an option. Good Luck

I like you have had one misjudgement of my normal character, it got me a misdemeanor of theft, this was 10 yrs ago, since that time I have graduated from LPH school and have had a fairly easy time obtaining employment, its keeping it that I m finding difficult. I live in a rather small tricounty area and as you know nurses dont stay long in a position esp in LTC, so I am continually running into people who either are familiar with my past or know someone that is, even though my past is my past I have left it there unfortunately others haven't, so of course you have the nurses who would rather stir up trouble for you than to work by the oath they have taken to do no harm and to care.. It breaks my heart that I am currently seeking other career avenues because of the mental anguish this causes on me because I truley love what I do and I know in my heart I will never repeat my past but thats no fun for coworkers it make much more enjoyable story to plot ways to set me up..... Im sad and lost and unsure of where my future lies.

You need to call the court and find out how to get the record corrected (its not likely to be expunged). I have a misdemeanor worthless check charge from 7-8 years ago and had no problem getting a job.

It is not impossible ... I had a battery charge come up on my record on a background check run by my employer... All I had to do was tell her a little piece of the story. I still got the job (you can see my post "Proof that a record won't hold you back from the job of your dreams"
