Just want to make sure I am going down the right track and not made any mistakes.
I passed NCLEX Oct 2005, applied for Visa Screen with cgfns Aug 2005, they now have all documents and are just waiting for NCLEX results.
I sent a letter to Vermont about 5 weeks ago with a cheque for $20 for them to verify licence.

I have checked my bank account today and this still has not been cashed. Do you think it would be wise to cancel cheque and start again and resend every thing.
I have agency in Orlando FL waiting to file for I-140

Not sure what the hold-up is, you do not need the VSC to start the process. You just need it in your hand when you go for your interview at the US Embassy. You only need to have passed either CGFNS or NCLEX to begin the petition process. I suggest that you contact your future employer again, they need to find a better immigration attorney.
If you applied for the VSC in August, did you list Vermont on your application as having a license with them at that time?
And just phone Vermont before you start the paper trail again, it may have just gone to a wrong file.

Sorry, but he is 1000% wrong. Get a new attorney if you can. You have wasted several months already. As soon as you had verifiable results of you passing NCLEX, that is all that he needed.
Example, look at all of the Filipinos that post here, their processing begins as soon as they pass CGFNS. They need the VSC for the Embassy interview, and they even take the NCLEX in the US.

Ann, PM me with the name of your Attorney. I'm just wondering if it's the same as mine, given that we have the same employer.
Suzanne is correct, the VSC is not required at the time of filing I-140.

That was the correct thing to do. But your immigration attorney has incorrect information. Are you required to work with him? If not, I would try and find another one, or it sounds like you are going to have continuous issues with him. Is he an actually an immigration attorney, or just an attorney for the facility?
This is very basic, and the fact that he diesn't know it sends up a red flag to me.

Hi Suzanne,
This is an immigration attorney, with her own law offices in Orlando. Apart from an initial delay (which was due to the hospital HR not producing the financial documents in a timely manner) I am having a smooth run with this attorney. As you know, I got I-140 approval in October, and I just heard from NVC that they have already received the completed packet 3 from her. So I'm not sure about this issue with Ann's visascreen. When I first met the attorney, she told me she wanted me to get visascreen as soon as possible, that she wanted to have everything good to go when needed, try to save time whenever possible (have all our ducks in a row as you say :wink2: ) So hopefully it's a misunderstanding for Ann, or a communication issue.
It seems they have already filed the I-140, good of them to let me know.
I have requested they keep me up to date in the future of what is going on.
We still mantain that is what the attorny said to us in Oct both me and my husband heard her say VSC before I-140 but perhaps it was cross wires.
Anyway thanks for the help it will be something new next week-month!!! :uhoh3:

Is it best to send everything all at once when applying through NY?
I thought I remembered you telling someone to tick the box on the visa screen form for that saysyou have passed NCLEX even if you haven't because it will tal=ke them ages.
Also I am concerned that I am sending CES NY app to one address and visa screen app to another.How will they know to pass my evaluation for NY CES to visa screen ?

Don't tick the box to say you have passed NCLEXeven though you haven't, will cause a lot of problems and delays if you do.
With NY BON they have special arrangement with CGFNS to do all the work, are you using that form?
Yes I am using that.Not sure what everyone else thinks and I know people get frustrated with us but I sometimes wonder if they try to make it difficult.not surprised people use agencies. This site has been a godsend .
wOULD BE GREAT IF there was a nice flow chart to follow for foreign grad nurses.It's not the form filling its more who does what, and which form and where to and when and getting cheques in foreign currency etc etc
