your not allowed to file 2 petition at the same time. only one immigrant petition is allowed and will be approve by the uscis and be given a priority date. do not attemp to do so to avoid some problems that may arise from it. learn the virtue of patience.:loveya:

No you can not and if discovered they will cancel both

The US Government will immediately cancel out both petitions and you will be back to Square One if they find out about this. It is not permitted by US Immigration Code.

But also be aware that each facility will be spending more than $5000 to get the paperwork done for you and you will be expected to repay them for the fees spent if you get denied because you had attempted to have two simultaneous petitions going at once.

Bad idea.

And right now with the expected wait of more than five years, it would not be a wise thing to do. Hospitals as well as employers are getting more timid in even wishing to start the process now for someone, and then when seeing something like this, it will make things even worse.

my employer has filed for my green card..and i have of course inc. my spouse in the application...now that we are in the waiting game, can a employer file a green card for my husband, as he being the primary applicant?????????????

That would give him a second immigrant petition, even if the other one is as your dependent. Why would you want a second employer to incur thousands of dollars of expenses when it will not benefit any of you? That makes no sense to me.

An immigrant visa is still an immigrant visa, whether primary or dependent.

what if an EB3 was filed, then the bf proposed and want to file a K3 visa? would it be possible? will there be a big problem on that? thanks.

That is a different instance. We were talking of being petitioned by two different employers for an employer driven green card.

No issues with being submitted for the K-1 visa, but you will have to prove that this relationship has been around and ongoing for sometime, they are reviewing things quite closely now because of the retrogression.
