Ratios for ED Boarders

California has a 1:4 nurse/patient ratio in the ED and 1:3 ratio for step down patients. When an ED RN has 1 or 2 step down boarders, does that 1:3 ratio apply meaning that RN can only have 3 patients even if the other 1 or 2 are not step down level of care?
