    If the hospitals could bill for nursing hours separately instead of including us in the furniture I'm guessing we would have ratios of about 1:3.

    Yeah... No! 
    I am from the UK so am not going to help at all, but before my American colleagues tell you, I will say it... You joined Allnurses less than 30 minutes ago and expect someone here to do your work for you without even saying what YOU have done - not going to happen.
    And as an addendum, why on earth would you expect people to click on random links on t'interwebs? That way lies viruses (virii?), malware and all sorts of nasties.
    I know this sounds a bit harsh but please learn a bit of etiquette before asking for help.

    There was way more to it than what you have surmised but you couldn’t possibly know that without reading the CMS.

    So AbstractRN2B I’m assuming that your “dislike” of my post is indicative that you didn’t actually read the CMS report. Since you aren’t actually a nurse yet you might want to have a look at it so you have a better grasp of what not to do if you want to be a prudent nurse. I would encourage you to try to identify every step that RV did wrong (there are at least 12) so you get a better understanding of the importance of diligence and attention to detail in your nursing practice. This will make you an excellent provider and your patients will benefit.

    Did you read the CMS report? Or the actual charges? If you had it would be blatantly obvious that her actions absolutely fit the definition of reckless homicide and she needs to explain herself to the public. As far as her being honest. She really had no choice, the error was discovered by another nurse so there was no way for her to cover it up. Plus the patient, you know, died so that’s kind of hard to ignore. What Vandy did after, while extraordinarily slimy, has zero bearing on what RV did. She’s not being scapegoated. She royally screwed up and is being held accountable.

    No it isn’t. Precedent was set years ago and the wildly exaggerated hordes of nurses being criminally charged for med errors simply has not happened.

    Because if RV had followed even ONE of the standards of medication administration after not looking at the vial the patient likely would have not died. That is what makes it different which I thought was pretty clear when I listed several other things the surgeon could have done that would have made me think it was criminal. As far as I’m concerned there were no systemic errors that caused RV to act as she did. That was entirely on her and nobody else. She alone is responsible for her practice. 
    Also, the facts aren’t lining up for what happened to this patient so I’m reserving judgment until I have more details.

    This is very different than what happened in the RV case and I believe there is more to this story as some of the details don’t add up.  A simple stent placement in a normal kidney even if it’s the wrong kidney should not result in a patient needing dialysis for “life”. Regardless, the physician was not the only person tasked with assuring that the correct surgical site was chosen. The “time out” procedure involves the majority of the OR team. There is a system component to this as well as individual. Hopefully the licenses of all involved have been impacted and the surgeon, as the team leader, should have his pulled. The rest seems more suited for a civil action.  Now, if the surgeon refused to scrub, didn’t wear a mask or sterile gloves, wiped the instruments on his jeans before using them, sneezed into the incision, got the mesh tubing from Quality Farm and Fleet and closed the patient with stuff from his mom’s sewing kit then perhaps criminal charges would be appropriate.

    That argument hasn’t really been proven true. Another poster did a search and found only 3 cases, including RV, since the late 90’s. None have resulted in jail time.

    I don’t know you so you needn’t worry about me taking it personally. I tend  to refrain from “rating” people negatively, unless something posted is just awful, as it serves absolutely no purpose and I find it childish. I’d rather have an adult discussion about differences of opinion.

    When I worked in the ED the ED physician wrote basic admitting orders that would at least cover the patient for a couple of hours on the floor until the admitting MD got there. At the time it was a paper form of standing orders that could be checked off with IV fluids, pain meds, antibiotics, diet and anything additional that pertained to the admitting diagnosis (nebs, lasix, etc.)It took maybe 2 minutes to fill out and seemed to work pretty well.

    My hospital promotes people who worked bedside for 6 months to be directors of nursing, quality managers, etc and suddenly they are telling nurses with 20 years of bedside experience what they are doing wrong. Also a nurse who worked exclusively mother baby is now the manager of all the Med/Surg units. We are supposed to say the word “prefer” as much as possible... do you prefer your pills with juice or water? So that when the survey goes out patients will answer positively the question “Did staff take into account your preferences?” Subliminal brainwashing 👍most of our patients “prefer” to go out and shoot meth into their PICC and then wonder why they got CLABSI 🤦🏻‍♀️

    Problem is, now they are thinking of making an NP write the orders, someone with credentials and privileges to write such orders as a licensed provider. That alone makes me shudder to think that assuming such a responsibility on patients I didn't even see is not a set up for legal disaster.
