Possible to break Rn Residency contract

Published

Hi all, OK well I signed a contract that says I will do the two years. I haven't taken NCLEX, so of course there has been no orientation. I did however take a drug test. I need to rescind the contract. Anyone familiar with this type situation or who can share their story? They haven't paid me one cent. Thanks

You're being a bit vague. Why do you need to end the contract?

Once you sign a contract, you've signed a contract. What does the contract say about breaking it? Did you read it before signing?

Speak to a lawyer, my guess is, if you haven't started working for them and they haven't paid you a sign on bonus, you can break the contract, an employer cannot force you to work for them.

Check the language of the contract; usually, contracts include language about the circumstances under which either party can walk away from the contract, and what the consequences are for breaking the contract.

If the drug test is the reason you need to rescind- they'll be cancelling, trust me.

That's the only reason I can think of that both were mentioned in the OP. But, OP, you need to read your contract and see what it states.

Nooo, the drug test isn't the issue.

The consequences are that I repay them, but I haven't received anything. Not one cent. Not even orientation. No paperwork besides, the contract.

Yes, I did. I just have to repay. Nothing has been paid out. Its contingent upon me passing boards. I would like to take another position at another hospital. The pay is a little less, but the experience is priceless. Also, the shift is now an issue due to family issues that have emerged since it signed. Thanks

AN cannot assist you. You need a lawyer to review the contract.

Just wanted feedback. Simple
