Pictures of a deceased patient on social media HIPPA violation ?

Published

I am a CNA in a nursing home. I recently had a resident pass away, after 3 years I was very close to her and her family. Her son had taken a picture of her and I last year around this time and I was wondering if it would be a legal issue to post it on social media, kind of as a memorial, even though he gave me written permission to do so?

Yes and it would likely violate your employers policies. Other family members might object. Just don't do it.

Keep social media and work separate

Oh, I would not do this. If the family feels that some sort of social media memorial is appropriate, they can do it.

I agree, Don't do it!

BIG no-no. I'm glad you asked us.

I wouldn't. As a CNA myself, when a resident passed away, I would keep it to myself. No social media.. nothing. It is a violation against HIPAA. Even if the family allowed it, your employer might think otherwise.

I also vote No. Your heart is in the right place, but doing this can only lead to a world of trouble. Someone (HIPAA, patient's family, your workplace) is bound to take offense to it.

A big fine and termination at minimum...
