Petition for Declaratory Order-Texas

Everyone knows when you fill out the background check and get fingerprints done it says DO NOT INCLUDE Class C Misdemeanor Traffic Violations. I was arrested for a Class C Misdemeanor Traffic violation (failure to pay a speeding ticket/failure to appear) but did not list it on my application because it says not to. I received the letter from the board requesting a declaratory order requesting the following:

1. The Petition for Declaratory Order Form (WITHOUT A FEE)

2. A written statement in my own words about what happened

3. All court documents regarding the case

I got all of this information within three days of receiving the letter and made sure my documents were certified, and even got a letterhead letter from both the court and the police department stating the case was immediately paid for and closed out and that I had no other charges. My Husband is a police officer and said that the reason they state not to list any Class C Misdemeanor Traffic Violations is because some agencies report them, and some don't (regardless of if its an arrest). I know how long the TXBON says it may take to hear a response, I've read everything on their web sight (so no copy and paste of their timelines and rules are needed. I've read them). I must be approved by August 5. I hand delivered my package to the Tx Board of Nursing in downtown Austin May 4.

Does anyone have any thoughts on the matter?

If they said I didn't have to pay a fee, does this mean I'm more likely to be approved without going to the Enforcement Dept?

Why are they making me Petition a Class C Misdemeanor Traffic Violation? Regardless of if I was arrested or not? When the application clearly states not to include them?!

My guess? It's the arrest that flagged you. Other traffic moving violations that don't include arrest (speeding, reckless, etc) usually don't even hit their radar screen if the fine is paid on time. I'm sure it'll all turn out OK. Did you already complete your jurisprudence course? If so, you can look through that material for additional info on the 'do's and don'ts in Tx'.

I was recently approved with a 15 year old felony and two misdemeanors that are 7 years old. You'll be fine don't worry. Just file the order and I'm sure it won't go to the enforcement agency.

as long you sent all the required documents and your statement, you should be fine. The only worry is waiting, TXBON takes their precious time sometimes. Good luck!
