PA Mandatory Overtime Message Muddled
There are three major mandatory overtime bills currently in the
legislature. Senate Bill 989, sponsored by Sen. White, is an act amending the Professional Nursing Law and prohibits
mandatory overtime use as a regular means of nurse staffing in state hospitals and healthcare facilities. This bill was drafted and heavily supported by PSNA. It was referred to the Senate Labor and Industry Committee.
House Bill 1959, sponsored by Civera, is an act prohibiting mandatory overtime and excessive duty hours of all
health care workers. This bill had been referred to the Health and Human Services Committee.
Senate Bill 1102, sponsored by Tartaglione, is an act prohibiting mandatory overtime and excessive duty hours of all health care workers. This bill has also been referred to the Labor and Industry Committee. PSNA supports SB 989 as it addresses only RNs and is a more moderate piece of legislation.
PSNA's position on mandatory overtime legislation is that the use of mandatory overtime is a healthcare issue not a labor issue.
Even though they are more restrictive pieces of legislation HB 1959 and Senate Bill 1102 seem to be the two bills that are getting the most attention.
PSNA is working on strategies to look at the issue and the various pieces of legislation and for that reason implemented an informal mandatory overtime survey via the PSNA web site. Data is still being collected.
