International RN with a Temp License in CA

Hi Suzzane,

I am here in CA on L2 visa. I have completed my BSN from India and pass the NCLEX exam for NY state on last month. Currently waiting for the endorsement to CA state. I got a Temp License last week. I have a valid EAD for 1 year which i have received through L2 visa.

I am looking for an employer in San Jose local who can process the green card. I haven't took the IELTS exam yet.Do i need IELTS to start with the GC process ?

How long i need to wait to get my GC if i get an employer soon ?

You need to take the English exams and get a Visa Screen Certificate. There is a retrogression in place right now, and therefore you cannot have an I-485 petition even submitted. They have not been accepted since last October 31. You can find an employer but they will not be able to do anything else other than submit the I-140 petition and then everything stops.

We have no idea as to when visas will be available again, we know that some will be released in October, but other than that. No idea how many will be available or if certain countries will still be under retrogression and that is what I am expecting at this point in time.

You can start working now with the EAD under the visa that you have, but anything more than that at this time will just be a guess as to when things will get done. Until there are visas available, you cannot even do much with the process, USCIS is not accepting petitions for the Adjustment of Status at this time.

As far as hospitals in that area, it is going to be quite hard. There are so many Americans that apply, that they can be selective. And many want to see the green card before investing in training you. They want to know that you will be able to remain and work longer before starting.

In the South Bay area, you may need to start at a nursing home to get the required experience for a hospital. That is what most in that area have been doing.

The big issue is also the visa that you have. You have an EAD for one year, and there is no requirement that immigration has to renew that EAD. They can change at anytime. That plays a part of it as well.

You can try looking in the Santa Clara area, further south, but suspect that you will get the same answer from the hospitals there as well.
