    [font=myriadpro-light][font=myriadpro-light]several years, the cap on h-1b visas was not[font=myriadpro-light]
    [font=myriadpro-light]reached during open enrollment, which started 1 april 2009. by 29
    [font=myriadpro-light]may 2009, the united states citizenship and immigration services
    [font=myriadpro-light](uscis) announced that it had received 45,800 h-1b petitions
    [font=myriadpro-light]counting toward the congressionallymandated
    [font=myriadpro-light]65,000 cap. enrollment will
    [font=myriadpro-light]remain open until that figure is reached.
    [font=myriadpro-light]the h-1b is a working visa that allows a
    [font=myriadpro-light]u.s. company to employ a non-u.s. citizen
    [font=myriadpro-light]for up to six years. because applying
    [font=myriadpro-light]for a work visa is
    [font=myriadpro-light]generally quicker
    [font=myriadpro-light]than applying for a u.s. green card, staff
    [font=myriadpro-light]required on long-term assignments in the
    [font=myriadpro-light]united states are often initially brought in
    [font=myriadpro-light]using visas such as the h-1b.
    [font=myriadpro-light]health professionals, such as physical
    [font=myriadpro-light]therapists, occupational therapists and
    [font=myriadpro-light]medical technologists often enter under
    [font=myriadpro-light]the h-1b visa. a few baccalaureateprepared
    [font=myriadpro-light]nurses who have been recruited
    [font=myriadpro-light]for positions that require a degree may be
    [font=myriadpro-light]eligible to enter the united states under
    [font=myriadpro-light]this category.
    [font=myriadpro-light]the uscis will continue to accept
    [font=myriadpro-light]regular cap-subject h-1b petitions until a
    [font=myriadpro-light]sufficient number has been received to
    [font=myriadpro-light]reach the statutory limits.

    [font=dinmittelschrift][color=#006c67][font=dinmittelschrift][color=#006c67][font=dinmittelschrift][color=#006c67]what is a 'cap'?
    [font=myriadpro-regular][font=myriadpro-regular]the word 'cap' used in this update refers to annual numerical limitations set by congress on
    [font=myriadpro-regular]certain nonimmigrant visa classifications, eg, h-1b and h-2b. caps control the number of workers
    [font=myriadpro-regular]that can be issued a visa in a given fiscal year to enter the united states, pursuant to a particular
    [font=myriadpro-regular]nonimmigrant classification. caps also control the number of aliens already in the united states
    [font=myriadpro-regular]that may be authorized to change status to a cap-subject classification.

    [font=myriadpro-regular][font=myriadpro-regular]the h-1b visa program is used by some u.s. employers to employ foreign workers in specialty
    [font=myriadpro-regular]occupations that require theoretical or technical expertise in a specialized field and a bachelor's
    [font=myriadpro-regular]degree or its equivalent. typical h-1b occupations include architects, engineers, computer
    [font=myriadpro-regular]programmers, accountants, doctors and college professors. the h-1b visa program also includes
    [font=myriadpro-regular]certain fashion models of distinguished merit and ability and up to 100 persons who will performing
    [font=myriadpro-regular]services of an exceptional nature in connection with department of defense (dod) research and
    [font=myriadpro-regular]development projects or coproduction projects. the current annual cap on the h-1b category is
    [font=myriadpro-regular]65,000. not all h-1b nonimmigrants are subject to this annual cap. please note that up to 6,800
    [font=myriadpro-regular]visas may be set aside from the cap of 65,000 during each fiscal year for the h-1b1 program under
    [font=myriadpro-regular]the terms of the legislation implementing the u.s.-chile and u.s.-singapore free trade agreements.
    [font=myriadpro-regular]unused numbers in this pool are made available for h-1b use for the next fiscal year.

    [font=myriadpro-regular][font=myriadpro-regular]the h-1b visa reform act of 2004 makes available 20,000 new h-1b visas for foreign workers
    [font=myriadpro-regular]with a master's or higher level degree from a u.s. academic institution. for each fiscal year, 20,000

    We are aware that H1b visa quota hasn't been reached and it is the first time for many years which is a good indication on how the current US economy is. Nurses still have to meet criteria and no guarantee that the employer will assist with GC and can pay you lower than a USC and if H1b is cancelled then you have to leave the US unless you can find another employer
