Are you a GC holder already?

There are no legal visas to work in the US with the LPN license, no matter what you may be hearing. If you do not already have a green card or a US passport, taking the exam will not benefit you in any way.
There are no legal visas available, only a few that will get you deported for immigration fraud if caught.

.
It could benefit her to take the NCLEX if she has an American fiance and he is has turned in the K-1 Fiance Visa.
That way by the time she arrives in USA form PI, she would already be RN, assuming she passed the NCLEX, Is that correct?
The OP was asking for PN. Unfortunately, if it were taken outside the US and do not have another visa through another route, they cannot work as PN as the PN is not qualified to be petitioned by an employer. Anything that needs to be petitioned via employment-based petitioning needs to be a job category that is in shortage and one that a US Citizen cannot fill. Also, anyone educated outside the US and wants or needs to be petitioned via employment needs a minimum Bachelor's degree.
To be able to work, legally as PN, they should already have another visa that permits them such as being a GC holder via family-based petition and other routes. K1 maybe one of them. See: http://travel.state.gov/visa/immigrants/types/types_2994.html

We have two different NCLEX exams in the US, one is for the LPN and the other is for the RN license.
There is also no mention of a fiance visa anywhere in her questioning here.

California have had this requirement since the beginning of this year and unless you can prove that you can not take the exam then they will require it. They have been very strict with it and usually require a letter from PR stating you can not sit the exam and because you only have a GC then you are not exempt. Much has been written already about this so suggest a read and search
As a green card holder, you are not exempt from the requirement to have the NLE exam written and passed. When did you actually apply to CA for licensure? If after January 1, then this is required of you and no excetions are made as you are still considered a citizen of there and hold a passport from the Philippines. Correct? Unless you are a citizen of another country and can prove that you also cannot write the local license of your own country, there is not going to be any exception made to this ruling.
Did CA actually grant you permission to test? You stated that you are waiting for the ATT, but have you been given the okay to sit for the exam by CA?
thank you verymuch. for all the replies.
this is the letter that i submitted to the brn. i just feel like posting it.
i hope i can get some replies from people who have this kind of situation too. i hope i can still take the nclex-rn exam eventhough i am just a green card holder. guys do you think they will reconsider me?
board of registered nursing,
good day, . i am an international graduate of bachelors of science in nursing. i already submitted all of my requirements and application form last february 2008 to take the nclex-rn but i am not a licensed nurse in my country (philippines).
i am very sorry for not including my written explanation letter upon submitting my requirements because i wasn't aware that i have to include a written explanation together with my diploma.
the reason why i do not hold a license in my country it is because i already applied for a re-entry permit twice since year 2004 to go back in the philippines to finish my studies. when i graduated last year 2007 i decided not to take my local board exam and came back here immediately because i can't take the risk of loosing my green card based on the assumption of abandonment of attention for my absences from the united states of america and i need to keep my permanent resident status.
i am hoping for your kind consideration.
