Got into LVN school. Found out about my 27 year old DUI. Will they yank me now?

Published

Got my background check back and the Texas BON found a reckless conduct from 1987 and DUI from 1990. Reckless conduct was racing and the other guy crashed. Unharmed. The DUI was when I was in the Army in Maryland. You know when in Rome. Classes start January 17, 2017. Will the school yank me and if not will the Texas BON let me sit for the exam? Would like to know before getting started. Hate to do it and then not able to practice. Insights???

Why don't you ask all those questions the admissions people at the school you are applying to/have applied to? If they conducted the background check, they should be able to explain what happens to you now that your past sins have surfaced. Good luck!

You can also contact the Board and see what words come out of the horse's mouth, after all, they will be providing, or not providing, the license.

Contact the state board through both email and phone. The school may let you complete clinicals and then you may find out you're not able to be licensed. This happens frequently where the schools throw up a disclaimer "we don't guarantee anything."

What does that have to do with getting a DUI?

I have had really good experiences with getting questions answered from the Texas BON, especially with regard to email queries. It's worth a try.

I would definitely contact both your school and the BON with this question. As to the school, it's more likely that the problem would lie with the clinical facilities. Some of them are sticklers about allowing students in with any kind of criminal history. If you get a positive response from the school, I'd float the question by the BON as well. Obviously, you will not make any kind of comment about "when in Rome" when you are explaining your history. You will highlight the fact that it was almost a lifetime ago, you have completely turned things around, etc.

For offenses committed so long ago and with subsequent perfect behavior, is there any chance you could get them expunged?

No on the when in rome? Texas BON isn't a governing body that enjoys humor? Yeah you're right. I just the letter few days ago and spoke with a lawyer. That is something that I will explore. Lawyer I spoke with is a friend and not a nurse attorney. Some of the post I've read that even sealed records show up on background checks. Rather know before getting started. Funny thing is I'm taking a CMA coorifice right now. Have my CNA. Nothing on those. I'll still work with the public just not as a LVN if they won't let me. It's my calling and look forward to having a chance to help! Anyway thanks for looking and responding!

I second this. They actually reply pretty fast to emails. I was surprised because I heard all about how BONs are notoriously slow at responding. When/if you do send an email, be serious & include all the details.

OK - here's the deal. A few years ago, our process was changed to require a background check as part of nursing school admissions... so no one will end up in the situation described by PP; graduating only to discover that you are not allowed to take NCLEX. It's working out as expected.

The issues described by OP appear to reflect 'young and stupid' actions. But our BON takes a very rigid stance against "failure to disclose" - despite the fact that OP probably just forgot about these events rather than tried to cover them up. This will need to be sorted out before a nursing program can admit OP. IMO (not a legal expert), this should turn out all right but probably will cause a bit of a delay.

There are people who have been nurses for 7 years that were born when you had your DUI. I think it'd be ridiculous if they kicked you out or if the bon didn't let you sit for your boards. just own up to it and if necessary, show them that you've stopped with the fast and furious and the boozing and cruising

They will let me take the test. I'm a mountain builder out of mole hills! haha
