Call Back Pay and Overtime Hours

I'm hoping that someone can help me understand an issue I am dealing with. As of now I signed a contract for one OT shift weekly. So that being said I work four 12-hr shifts a week. Here is my issue:

My schedule for the week was to work Monday, Tuesday, Friday and Saturday. So that would normally be 40 hours regular pay and 8 hours of overtime pay.

This is what happened that week:

On Sunday I get a call saying they were desperate and needed me to come in and they would give me call back pay, which is 1.5 times my regular rate. Ok, I go in.

I then work Monday and Tuesday, and have Wednesday off.

On Thursday, I get a call again saying they are desperate again and need me to come in and they will give me call back pay again (1.5 times my regular pay). So I go in on Thursday.

I then work Friday and Saturday as well.

So I have a total of 72 hours. I hit the 40 hour mark on the second call back shift on Thursday, so I thought that Friday and Saturday would be straight overtime pay.

Here's what my hospital did. They did not count either call back shift towards the 40 hour week. They counted Monday, Tuesday, Friday and part of Saturday, and I only got the overtime pay for hours worked on Saturday.

Is this right? Shouldn't the Sunday and Thursday be counted towards the 40 hour week as hours worked regardless of being paid OT for those two shifts because they were coded as call back pay?

You could always call your payroll dept and check. When I worked 0.9 12 hr shifts though, I was always scheduled Mon, Tues, Wed, Fri, Sat, Sun followed by 7 days off. The hospital got around it by saying it was

I am paid biweekly as well, but overtime is based off a 7 day work week. One week doesn't affect the other.

I work OR. Our call back is separate from the regular hours used to determine overtime hours. So, I can get called in for 12 hours on a Sunday, be off on Monday for low census, and work the rest of my scheduled shifts. I would only get paid straight time for the scheduled shifts, PTO for the low census day, and time and a half for call back. The call back hours are not counted towards the 40 needed to qualify for overtime.

I am currently a new grad RN and finished signing papers, but I remember reading somewhere that OT only applies to ONE WEEK. This is the state of California, but I am sure it applies nationally possibly? So if you worked 72 hours, IMO should be 32 hours of OT pay.

My hospital counts any hours worked towards your 40 hours. So, 72 hours would get me 32 hours of overtime that week in addition to any incentives they offered. I'd be exhausted and rich :)

I'd be willing to bet that their crappy OT policy has a little something to do with why they are desperate!

I usually hold out for call back pay and movie tickets before I go in.

Our on-call works like holliewood's policy. And if for some reason I work 40 hours before I'm called in, I get on-call OT pay which is double time. I love those checks.
