I was wondering if anybody has signed up with AVANT HEALTHCARE PROFFESIONALS, a USA based agency for NURSES and PTs, which currently sponsors NCLEX-passers. Any updates with your application?

I have started this thread thinking we could update on the process that you are undergoing since US visa bulletin is fast moving.

I thought the 4 weeks is all about Avant because USCIS has promised 15-day processing in exchange for a significant fee of $1,225. If they fail to comply with their deadline guarantee, they need to return that money and still continue to expedite the processing of that specific visa.

I was thinking maybe Avant will inform me about the approval in 4 weeks instead of right away because of the high volume of refiled petitions they currently have.

Yeah, and like I wrote earlier, of course I'd like to know as soon as possible but I guess I don't mind waiting for the response from Avant because regardless of knowing whether the petition was approved or denied, I need to wait again – wait to have the case transferred to the NVC or wait to have a petition refiled again – and during that waiting period, there's nothing I can do to further my case, you know, my attention is not needed.

Unfortunately, there have been delays and many RFEs and denials.

Someone already had their petition refiled but received an RFE that was addressed to the company. I'm wondering what it is this time that the USCIS is coming after since the employment agreement was already reworded.

So sorry to hear this. Did they tell you why it was denied? I would make that decision based on what they propose next. Have they given you a way forward?

Did you already receive a second denial? Did Avant suggest a new plan?

I think you can get out of the contract at any time but with the consequence of paying up – they will require a compensation for all the efforts and work they have put into getting you into the US. Only Avant can tell you the real amount you owe but after the NCLEX the money you'd owe is around $3,000. Nurses who pay for a lawyer's services themselves can spend about $10,000 to $15,000. I'm not sure if it's the same under Avant but this might give you perspective on the amount you owe them if you decide to drop out from the process now.

I know people who are frustated with an RFE on their second petition and are considering to pull out. The process has been an emotional rollercoaster for all of us. I'm not sure if there'll actually come a point when Avant declares immigration is not possible and decides to end the contract on their initiative but I've decided to keep trying until then. Hopefully that day doesn't come and we all get to work as nurses in the US.

Is your petition actually refiled along with the premium processing? Or did they file a premium processing for your prior petition? Because I also received an email just today saying that I am eligible for a premium processing and they will file it later this week. But it isnt clear if my prior petition has been approved or denied. Regardless, I would like to follow your case. I think we are almost on the same timeline. Please let me know of the outcome of yours. Thanks!

My first petition was filed in August and denied in January, 5 months later. I waited 1.5 months to have my petition refiled and in the meanwhile I signed the reworded employment agreement and another ETA 9089 form. Now the second time my petition was actually filed with premium processing and today the 15 days is up.

If you had a petition filed earlier and they're now filing again, it means your first petition got denied for whatever reason.

I'll update my case here as soon as I get the news.

So 15 days on the dot, my I-140 petition was approved without any RFEs ;)
