AOS process and August Cancelled Interviews

I am seeing a lot of comments on this site that "USCIS was forced to accept I485's". That is sort of true due to pending litigation that was being sought after but nobody "forced" USCIS to put all cagetgories "current" in the original July Visa bulletin in the first place. I am also seeing a lot of frustration from those in CP that their interview dates were cancelled in August. I can only imagine how frustrating that would be when they had waited for such a long time, be so close and then have that cancelled. My sympathies to those that are being affected. But at the same time USCIS processed a lot of visas ina short time (about 60,000) and the bottom line is that those that were processed were technically ahead of those with interview dates that were proposed for August and later. As Suzanne has said many times Schedule A will be the best thing for foreign nurses but it does not seem likely that this will pass the current Senate, unless something drastically changes. But I am thankful for this site. I think it is nice that we have a way of communicating with each other like this as it assists those that find this process difficult to understand to have a valuable resource of information.

It is indeed really frustrating for those waiting udergoing CP. And to add up, it won't be as frustrating as it is now if we see approvals of AOS with PD's later than those interivews cancelled. If only that they just had given a specific date rather than making it "current" I think that things would be a bit different. It's like we were all waiting in a single line then all of a sudden they opened all the gates and we got mixed up.

They only assigned the visa numbers, they have not issued all of the visas to people that are getting them as of yet. There is a US Embassy interview for those that are overseas, and actual visas do not get given out until then. Just to clear that up.

Just to clear up things a little more for you:

In order for USCIS to be able to use up the uncapped visas for the year before the new fiscal year starts, they had to make all current. But they were expecting to do that only for a short time. And that is exeactly what they did. But then you had some of the immigration attorney groups yelling and stating that they had clients flying in to get the papers submitted, but we know that that never happened in the first place. There are residency requirements before the AOS can be filed. Due to all of the talk of lawsuits and the statement that they did something wrong, when in fact they did not, USCIS came out and stated that they would accept the I-485 but there are no visas available. Anytime that someone is forced to do something that they do not like, it does not mean that a majority will get approved as happened in the past. Expect those that came over under the tourist visa to face getting denied as many do not meet the minimum requirements nor can prove that they did not have dual intent. That is not what the AOS was designed for in the first place.
