Am I eligible to take NCLEX?

Hi guys, I really value your input on this matter.

Here's my data:

- BSN holder from the Philippines.

- Canadian citizen (my spouse is the principal applicant).

- I'm gonna start my Diploma in Psychiatric Nursing by November this year in Canada.

The issue:

My husband have a job prospect/offer in Silicon Valley. I am just wondering if a spouse of H1B visa holder can sit for the NCLEX exam given my circumstances? I was told that I am not allowed (cause 1. I'm not an RN from the Philippines 2. I am not American Citizen) but would like to hear some inputs here.

Also, I would like to study again. If we happen to stay in San Francisco maybe I can just study LVN there and cancel my upcoming schooling here. That is, if the visa permits.

I heard there is new H4 Visa EAD that can allow dependent spouse to work in the States. But after the I-140 (Immigrant Worker Petition) is approved.

You may find issues with CA as many International nurses have been denied application with CA due to concurrency issues. Plus you need a US SSN to apply and you will not get that without a valid work or immigrant visa. Suggest you check out the Nurse Registration forum fr issues with CA

It appears you can apply for work rights on H4 once your husband's application for immigration (I-140) has been approved
