I am currently on L2 visa which gives me authorization to work in US.My EAD expires in May 2013 and extension process is in progress.i could maintain this status for one more year. I have been working as BSN Rn in Operating room since june 2012.I also hold a Masters degree in Hospital Administration.

I recently got a new job offer from a large university teaching hospital for a full time RN position and i am planning to start from May.

My question is when is the right time to ask them, whether they sponsor me for H1b or green card. I am confused that if i bring out this visa issue rt now, whether they could withheld my job offer.I Do know that they have the international Division which provides visa assistance to international employees.I also would like to know about my eligibility to apply for H1B in this April.

please provide some insight in this topic..

Mariaj,You can start it as soon as possible. I don't see any problem in asking them as early as possible. I was an H1b visa. I moved from one employer to another. What I did is I talked to the recruiter and HR that I would feel comfortable working with them if they will sponsor my green card as soon as I start my employment and they did. You just have to be honest with you employer and explain your situation. Good luck!

Just be aware nurses generally come under EB3 for immigrant visa and due to retrogression looking at over 6 year wait and unless maintain legal residency can not continue to work whilst waiting for a visa to come available. H1b isn't always an option for nurses but the employer may be willing to go the route and pay all fees (it is a requirement they pay all fees relevant to H1b)

Every job I have applied for has asked if I have a legal right to work in the USA. I have to prove that I was born in the USA. When you filled out you application, you stated you have legal right to work int USA which you do with the l2 visa.Asking for them to sponsor you changes the situation. Does your new job a BSn?Does it require to a MHA? You will have to answer your legal status to work which presently you only have one year.

Which country are you from? It depends on if your category is current even if they agree to petition you for a green card. You would be able to file the I-140 even if the category is not current but not the I-485 which is the adjustment of status to a green card. However, if you are able to file when your category is current then you would be able to stay in the US while you are waiting for a visa number and work with a EAD which they seem to issue every two years now. Currently all EB3 categories are retrogressed however the Rest of World category is advancing more quickly since not many people were able to apply for many years ever since the July 2007 time period. There are certainly some but not nearly as many I-485 cases as in previous years. We applied in 2007 and are still waiting nearly 6 years later.

Can you not get the sponsor of the L1 visa to provide sponsorship for green card?
