You should be okay, as long as the petitions were submitted before they stop accepting them.

This November 2006 Visa Bulletin is something that was not really expected from my point of view. First I dont understand when is the cut-off day? There is no cut-off dayfor Schedule A because the I-140 petitions will be accepted even after November 2006. They will continuously get approved but the visa number will not be assigned until the Schedule A turns current again.

My second misunderstanding is that seems like everybody who have applied before Oct 2005 could get approved for immigration visa as well as to adjust their status. But I know people who have I-485 adjusted after October 2005 (and I am talking about Schedule A applicants)

So i am really kinda confused. My I-140 is approved already but my I-765 has not approved yet. And what will happen to my I-485?

Could the current Nov Visa Bulletin be mistaken and be instead October 2005 - October 2006?

The cut off date is for the visa processing. And you base your PD( the date when your I-140 was received by USCIS, Notice of Action) on the cut off date.

Processing of petition has nothing to do with cut off dates, its the release of visas.

"....any retro will apply to petitions submitted after October 31st, so you are safe, yours will arrive at Immigration within 4 days. Any petitions that go in after October 31st 2006 will retro to October 1, 2005."

Am I safe....? How long it takes to send my file to Embassy?

Hi! I'd like to know where you got the info. I am interested bin reading the entire statement because I am also confused if I am affected by retrogression because my priority date(I-140 received by Immigration) was Novemeber 2005. Please post the entire statement so we can read it. Thanks.

For AOS, what will happen to those who filed their papers before 90 days of stay? Like they file it after Oct 1st...

Not sure we are following you. Usually, immigration lawyers files a client's petition on the 61st day of stay or if they want to be really sure - on the 91st day of stay.

Anything below that has a good chance of being denied because it may be construed as having intent to change status rather than just visiting.

Some are saying that even filing on the 61st day still has a good chance of being denied.

You may refer to any immigration website or consult a lawyet for more details.

It will be up to immigration as to what they will accept and not accept. Because of the impending retrogression, there are those that will be pushing it to the wire. Definitely will be denied if it is less than 60 days, no question about that.

For the others, it will be up to USCIS, and they will make the determination on a case by case basis.

In normal situations, most attorneys like to wait at least 90 days so that it doesn't look like the nurse came to the US specifically to stay and work.

You previously replied in my message and I am grateful for that,Up to now I am still waiting for my dependents visa,I already send the embassy email and fax letter to follow up my dependents visa that is now going 3 mos and 1 week of processing from the date of interview.I also called up the embassy and they said that they will just file a report and follow up after 2 weeks.My question is when does my dependents petition really come in during the process of my paper?From the explanation of the agency,I understand that dependent name come in when I file my ds230 and not in the filling of I-140.Pls give me your clarification,ty for the help

Ther I-140 is strictly approval of the actual job offer, it has nothing to do with family, dependents, etc. Only you. Any dependents that are wishing a green card must be included on the DS-230 form, or they will need to be processed later and wait for a full two years before being able to join you. As long as they were included on that document then they are okay and will be given a visa without the extra waiting time.

I am really getting worried especially now that retrogresion is coming.I read your previous message in one of the member that US support the principle of keeping the family together.I keep on praying that it is true and that my dependent are given the privilige to be a recipient of the visa.Thank you again

If they were on the DS-230, then they should have visa for them.. But first question that comes to my mind, was their visa bill paid yet? Agencies usually pay only for the nurse, and not the family.

Hi there,

I am totally lost. I already have a case number MNL2006xxx. I recently received this letter.

"As soon as an interview date has been scheduled, the designated representative of this case (attorney) will be notified. The US Embassy or Consulate General may require additional documentation at the time of the interview."

Will I be affected by the retrogression and how long will it take to process everything?

This is the packet 3 right? and Im just awaiting Packet 4?

Your inputs will be highly appreciated.
