expungement

    even if it is expunged you need to be honest about it to the BON. things like that have a way of coming back and haunting you. you might want to just go through the declatory process its not that bad depending on the offense if you have anymore questions feel free to send me a message... I to had to fill out for a dec. order so im sure I can help you.

    I'll be petitioning soon too. Curious - have you received a response? If so, how did it go? How long did it take? If you don't mind me asking what was your situation? I have a couple of old misdemeanors, and I'm not really worried. They're petty, almost a decade old, and not all too uncommon among the mislead young. :wink2: Plus I have faith, and feel lead to nursing. So... anyways I'm feeling ok about it. Would love to hear another's story though. Lemme know!! Good Luck in all that you do!! That goes for everyone!

    The release or use of expunged felony or misdemeanor arrest records for any purpose is prohibited and the person whose records are expunged may deny the arrest and the existence of the expunction order.
    Reference: Texas Code of Criminal Procedure, Art. 55.03

    hey, I had a dwi from 7 years ago. I filed for dec. order in nov and got my response in dec. it was a misdemeanor. everything was a go so im cleared to take the rn lic. im sooo excited now.... I was terrified that I was going to be denied. but I think they look at age circumstances etc... hope this helps goodluck.

    i have a question? im getting my record sealed it was also a misdemenor and im also applying to nursing school. do you guys think ill get in?

    Before relying on this, I'd check with an attorney who has experience with
    how the Texas BNE and FBI background checks work. The FBI background
    check *will* dig up the expunged and/or sealed records - the question is
    whether they would report it to the BNE or not. I do know the FBI check
    will bring up deferred adjucated offenses whether the person has obtained a
    NonDisclosure Order or not. The state allows the BNE to have access to that
    information.

    I have heard this before and I do not know how true it is. but i think this is how it works even if you were arrested but not convicted it shows up on a background check.in other words it will show an arrest but not a conviction. A friend of mine told me this and he works as an HPD officer. Your best bet is to run a background check on your self and see what shows up.

    have a few misdemeanors from more than 10 years ago and was wondering if this will affect my application. have worked very hard and would hate for it all to be for nothing when background check is done nothing show up

    I keep reading in the newsletter of the Board of Nurse Examiners about how nurses get their licenses revoked among them was a woman from Texas who had 3 misdeameanors for theft and the facility found out and they had her license revoked. This is public information. I also have a misdeameanor from like 10 years ago and I wonder if it just depends on the type of offense? Can anyone out there enlighten us ???

    the only advice I can give you is to run a background check on yourself and see what comes up. but some background check companies only go back 7 years and the BON goes all the way back! If your misd. were over ten years ago I would just file for a dec. order the process is easy and it really does not take long to here back from them! goodluck
