Appellate court halts prosecution of nurses, attorney

Calling the charges unconstitutional, a state appeals court Thursday halted the Suffolk County district attorney's prosecution of 10 Filipino nurses who resigned from a Smithtown nursing home and their lawyer.

Suffolk District Attorney Thomas Spota won indictments against the nurses and Felix Vinluan, their lawyer, in March 2007, after they quit their jobs at Avalon Gardens Rehabilitation and Health Care Center.
