The nurse did the right thing in wanting to check the facility P&P's and or with her boss. If the incident occurred exactly as the "Chicago Breaking News Center" () described, then the officer may well be wrong. If this is the case, then the nurse should only sue for actual costs incurred, and not to "make a point". If the nurse wins and the officer is disciplined, the point will have been made on its own merit.

Nor to score a jackpot nor to retire early.

I'd love to see the cop fired (yeah, right) but I despise the "lawsuit as jackpot" mentality that is so prevalent. And then folks have the gall to say, "It's not about the money."

I am not yet a nurse (still a student), but I don't need to be in the profession to know that nurses take enough garbage on the job. Now I have to worry about being arrested for doing my job too? I was starting to rethink this career option. Wow, this really doesn't help!

Good for that nurse!!! All she did was defer the issue to a superior and not outright refuse. She was detained, but never charged with anything. I would think this is better than being charged with battery against a patient--you think?? Though these laws can have a lot of gray areas, I wholly support her decision and would have done the same thing.

When I saw this I was livid. I am not sure how a lawsuit is going to help (other than to enrich a greedy trial lawyer), but in this case, I hope that this nurse sues that cop to oblivion I hope she nails him --and the city of Chicago-- to the wall (although I'm not holding my breath).

To all those nurses working with her--make sure you remember this cop should he need to show up in that ER for treatment. He picked the wrong person to mess with.

Unbelievable...What was the big rush??? Keep the suspected drunk driver on hold until the results are in, not someone who is trying to save lives!!!

I agree. There are patients who have more priority over the DUI suspect. The DUI suspect and the officer would be low on my list of patients or persons to see. Really, did he expect her to just draw the blood and hand it over without consulting her hospital's P/P? If it was me, I would have refused too.

As with most things I suspect there is more information needed here. That being said I confess to being very wary of police in this country. I am sure most are fine but there seems to be an issue of power that messes some up. Plus they all carry guns (and presumably tazers) here.

I am a student nurse but even once I qualify I will always be learning. This nurse did exactly what I would have done myself...so the result, this nurse getting arrested, really freaks me out.

My son is a police officer and has combat medic training. This officer was probably a rookie, nevertheless, as a nurse, I would have had to follow administrative and chain of command, and this cop should have realized that--as he also has to do in his field. I wish he would have arrested me---CAN WE SAY PAYCHECK!!! AND LAWSUIT HERE!?

sounds like the cop was trying to do his duty. some hospital - they don't even have a protocol in place when the cops bring in a suspected dui? sounds like a breakdown in nursing/hospital protocols and communication
