I would love to hear what reason the cop had for arresting her. For not complying, or maybe she told him off or something? I know there are two sides to every story but it sounds like the cop was being an ******* and not listening to why she couldn't just do it. I'd like to respect law enforcement but sadly although I have never broken the law, I have been treated like crap by almost every cop I've ever had to talk to. They have a hard job but that's not a reason to go around treating everyone horribly. ER nurses have a really hard job too! I don't know if I could handle the drama.

I should be so lucky- With a so-so lawyer and a jury with any heart at all she can be set for earily retirement in no time. Only problem is she'll need it to move. I wouldn't want to be depending on that police force to serve and protect me after I took them to court. But you can bet your licence I would be more than happy to spend the night in jail for a good chance of that jackpot!

No charges, no paperwork filed on the "arrest".
Sounds like Chicago.

The officer did not have legal grounds to "detain" the nurse for following hospital protocol. He stands to be sued by the other patients in the ED as well.
It is for the protection of the officer's case that the nurse following hospital protocol,
otherwise the perp's attorney could use that as an argument to get the perp off the DUI charges.

Recently some jurisdictions turned to training officers of the law to
(get this) draw blood from subjects who are suspected to be under the influence of alcohol.
This really blurs the lines between healthcare and the law, and, I'm SURE it will be
challenged and overturned in higher courts of law.

I also read that there are numerous lawsuits over suspicious breathalizer tests,
that some jurisdictions/speed traps are falsifying breathalizer test results.

You are legally entitled to see the PRINTOUT of the breathalizer test.
Make sure that the printout pertains to YOUR case.
If you ask for the breathalizer printout and don't get it, or you get one and it's not yours, sue!

Some jurisdictions are also not following proper breathalizer procedures.
If you suspect the outcome of a breathalizer test, insist on a blood test (in a healthcare facility)
If you ask for a blood test, and one is not administered, contest and sue!

Fraudulent DUI stops are the new money makers for small jurisdictions,
just like Red Light cameras are the new "speed traps". But that's another subject.

Yes, there should be a lawsuit and she should collect.

There has to be a deterrent to power-tripping police officers making stupid decisions like this.

Why didn't the police officer just collect the blood sample himself?

After all..that is what he was asking her to do, technically.

In her scope of practice, she cannot draw blood unless she accepts him as a patient, otherwise she doesn't have the right to stick him...and she cannot accept him as a patient until the hospital does.

That is why 6-weeks of police academy doesn't cut it.

And that attitude represents part of what's so wrong with this story and our country in general.

Power trip???? I'm SHOCKED that you'd feel that way. Shocked, I say.

OK, not shocked at all, really. Sounds like the standard issue power-hungry "peace" officer. Remember - Mister Police Officer is not your friend. Your typical cop may act friendly, but in his mind, the world is divided into two types of people - Us vs Them. If you're not a cop, you're one of "them". You are subject to false imprisonment, physical abuse/injury/death, or having your life ruined on the basis of reports submitted by the "scrupulously honest" law enforcement officer. His buddies on the department will back him up 110% of the time (the famous "blue wall of silence").

For every incident such as this one, captured on videotape, there are bound to be many others not captured on video. If it comes down to just your word versus the cop's, you're going to lose.
