Nevada Stops "Medical Assistants" from Giving Injections

Injunction blocks ruling for medical assistants giving injections

They should have let her speak. That was the message Tracy Hurst had for the Nevada State Board of Medical Examiners on Tuesday after a judge approved her lawyer’s request for an injunction that prevents emergency regulations allowing medical assistants to give flu shots.

District Judge Kathleen Delaney ruled the board violated the state’s open meeting law during a Sept. 18 hearing to pass the regulations, which would have permitted medical assistants to give flu shots and other vaccines, but also prohibit them from administering injections of cosmetic drugs such as Botox.
At that hearing, some doctors on the board said they had to leave for luncheon engagements and, in danger of losing its quorum, the board voted unanimously to pass the regulations.

Three people had yet to testify, including Hurst, owner of the Medical Spa at Summerlin, and on Tuesday, Delaney ruled the board had violated the open meeting law by voting before all public comment was taken....

NYState PROHIBITS "medical assistants" from administering meds, yet MDs Offices routinely flout the law and compromise patient safety because they prefer not to hire an RN/LPN. Is it too much to ask that the law be enforced? MDs are the first to oppose any legal expansion of Nurse Practitioners' scope of practice, yet brazenly facilitate "medical assistants" performing NURSE-ONLY functions.

The facilities are too cheap to pay RN's/LVN's so thay hire MA's-no offense-to do these functions and more. Don't get me wrong, I've worked with some exceptional MA's but they were paid the same as I or more with less training!! This really bothers me b/c I worked my butt off for my diploma!!

My mother's MD office has MA's and it upsets me when seeking advice the put her to the "Nurse" and gets advice very quickly. She is set up for an epidural for pain management and was checking in relation to her "aspirin". The MA who states she is the MD's nurse told her to take her aspirin. If offices are going to tell pt's someone is thier nurse then have a nurse. Futhermore she recieved her flu immunization of which the "nurse" acutally an MA give it in the posterior aspect of her upper arm resulting in a sq now very swollen, eccymotic and painful! Nothing against MA's but tell pt's they are MA's.

My MD's clinic uses only medical assistants and even they don't claim to be nurses. I've asked them all personally if they were nurses. Not one out of fifteen said they were.

Personally, I think medical assistants are a great alternative to lower employments costs and are fully able to draw blood, give flu vaccines, and perform most routine examinations like blood pressure and pulse check and even document this data for the NP/PA/MD/OD/DPM/OD.

Frankly, I lost faith in Nevada after they legalized prostitution.

This is exactly the problem!!

IF I am going to get an injection, I want a NURSE. I had an MA give me an injection once, and lemme tell you, I can tell the difference..

First of all I am a MA, second when I am approached by a patient who is seeking medical advice, I refer them to the MD or NP. I hate it when patients see someone in scrubs and they assume they have the authority to dish out medical advice! Also before I do a task, I see if it is in my scope of practice, and if it is and I ask to be trained properly. I do not like to be referred to as a nurse either because I dont have my nursing degree!

A bit off topic, I know, but the state of Nevada has never had legalized prostitution.

Only one county (Nye) in the middle of the state, in the middle of nowhere - without a decent sized town in it. That's it.

It just kills me how people think prostitution is legal in Vegas, or Reno. It's not, never has been, never will be.
