Fla. fraud law may thwart some medical careers

by OldMareLPN Premium Member

A new Florida state law designed mainly to crack down on Medicaid fraud is having unexpected consequences by keeping some health care professionals from getting or keeping their licenses at a time when the state is suffering a shortage.

A little-noticed provision in the 160-page measure is preventing doctors, nurses, pharmacists and lab technicians from working in Florida if they have old felony convictions for fraud or drug

Sounds like the FLA nurses association is already working to change the law.

Small’s organization wants lawmakers to repeal the provision and go back to letting licensing boards make decisions on a case-by-case basis so they can take into account the severity of crimes and mitigating factors such as Campbell’s volunteer work trying to help other former inmates turn their lives around.

This is a shame. I thought that perhaps this law would put that slime that runs HCA out of business.

I don't have a problem with keeping convicted felons out of healthcare careers. There are lots of careers that you can't pursue if you have a felony conviction on your record -- why is it unreasonable for healthcare to do this? It's not like there's a shortage of people (who don't have criminal records) wanting to go into healthcare -- I think we can manage ...

The problem is currently licensed/educated HCW. If you say that I cannot ENTER _______ with ________ on my record then fair enough. I undestand that I am excluded. It is NOT right to come to me after $$$$ in loans or a family that depends on my income and tell me that I can no longer practice. Waaay backwards.
