So let me get this straight, if I have a work related injury and workmans comp (which seems to be a crock from what I have been hearing lately) denies the claim, so will my private insurance?

Yup, your private insurance forms have a box on them ,asking if the illness is due to an mva, or work related, if you check yes, they will defer payment to worker's comp....everyone justs banks on the fact that you will just drop the work related part...if private ins does deny, you can apply for an appeal(this is based on my state) f they decide that your illness is not job relatet...ONLY THEN do they pay. Hsps also have legal teams to deny and refuse payment. Interesting...some hsp are self-insured. (what happened to the icon where you were banging your head on the wall??)

This is tragic and wrong on several levels
*you should never have to be afraid to report an on the job assault or injury
*The insurance companys should take care of business and make sure Mrs. Mendoza and her husband get taken care of instead of acting like children.

insurance companies disgust me.

She was followed around walking to and from work (she doesn't drive) getting on the bus and getting her groceries with her husband. They took all kinds of photos and video images and denied her claim. The whole time she was coming to work, doing light duties in the kitchen and just not lifting over a certain amount. She did exactly what she was told to do. Consequently she was treated, in my opinion, like a criminal.
This happens all the time!!! YOU COULD PROBABLY START A THREAD ON WHO HAS BEEN ####** OVER BY WC AND THE STORIES WOULD MAKE A MIDNIGHT SUPPER WITH FREDDIE KRUEGER LOOK LIKE A GIRL SCOUT PICNIC!!!!:de vil:

I don't see what the confusion is amongst the insurance companies, the hospital or workmans comp. I t is so ridiculiously simple- and I know they have physician consultants employed for them. a person sustains a blow to the head,the brain is a closed contained compartment, it will only accept a certain amount of pressure(intracrainial pressure) any little sepage of fluid into that compartment causes the intracranial pressure to rise( increased ICP) which can be blood or CSF( shearing forces cause this- cou and contacou, the brain goes foreward and then backward- this is BASIC critical care neurology, ripping and tearing ) in this case it sounds like blood seeped into the subarachnoid spaces and increased the pressure- she had a HEMORRAGIC stroke-can and should have been picked up on a CT scan ( should have been first on the list in the ER- part of the AHA stroke protocal, when she went to the hospital complaining of a headache and not feeling well, the increase in intracrainal pressure caused blood pressure to rise- part of Cushing's triad, the subarachnoid could not absorb the blood fast enough to balance the ICP( this is not a pre-existing HTN condition it's a pre-exsting neglegent condition) are you kidding me. What is wrong with these big heathcare businesses, more money in some CEO's pocket he/she doesn't want to let go of!!!
