Difficult Employee...What do I do?

I think it's interesting that here is the only manager I have ever heard say she feels the employee has the upper hand.

I am not fully clear on why you think she is a pain in the neck, other than that she won't do what you ask. She is injured and "in therapy", I guess. Foolish of her to mention the art classes. But why get mad at someone who is on medical leave.

Anyway, HR and Legal should be able to help you force her to get seen by your company doctor, who would probably be delighted to release her to RTW full duty much sooner than would her PMD.

If you really want to get rid of what I presume is a good worker, just not a real malleable one, do what HR says. It's their job to know. And steel your heart, lower the boom, and keep on going. Tough duties - that's what being the boss is like.

I just read your post again. I think it is time to tell her that the set schedule doesn't work - although I'm not sure it doesn't. It sounds like some jealousy is in play here, too, not just being irked with her set schedule. Most places I have worked have hat set schedules, though, to tell you the truth.

why not analyze what is really bothering you about her? Then you'll know what to do about her.

And when will her cases be settled?

Should I cut her hours down to nothing? What do I do? Oh, also, she has 2 worker's comp cases open against our company. They have been open for over 1.5 years and occurred under questionable circumstances. HELP!
Just schedule her. She'll either do it or she won't. What is she going to say? "I'm being mistreated because I can't paint on Mondays?" How ridiculous would that sound? You are right. It is her job. If she wants to keep it, then, she should be willing to be flexible also.
