what if my case is recent? I currently finished all my dui classes and now doing payments for all the fines. I have heard for a case to be expunge and get probation terminated is you would have to do a minimum one year. Good luck with your test, hope everything goes well.

Well my case was fairly recent as well, like I said when I initially applied to the board I was sill on informal probation , I got terminated early from probation and expunged my DUI typically to qualify for an early release of probation you should have completed at least half of the court ordered probation , but it's worth a try, don't forget in order to be released from probation you will have to complied with everything the court ordered, classes done and fines paid...keep trying there is light at the end of the tunnel, and when you feel like giving up like I did a few times just pray and ask God for the strength .

Can someone shed some light on my situation ? I'm an RN from nj licensed in ny and nj trying to endorse to California. I have my application together ready to send out this week. Explanation letter, 5 character reference letters, courts docs, work performance eval, and rehab efforts. I've been practicing as an RN for one year in nj. My bac was .24. Is Cali going to license me ?

Like yourself, I am an EMT-P soon to be RN, with a friend I grew up with facing 2 dui convictions in 2012, one may, one February and their license up for renewal in 2013, august. as you and I know as paramedics, we have automatic background checks at each juncture; yet I see questions in here as if RNs think they can "hide" a DUI. Don't they at least ask on license renewal "were you convicted of misdemeanor or dui in last 2 years"? And don't they do same background check we medics go through? And isn't LYING ABOUT IT then PERJURY and at least as bad as the DUI??????? I hope you have good outcome; you seem like great person who made an error once-won't "lecture" you about duis- you've been there in the blood and the mud; you know NOT TO DO IT! Good luck, and please reply-I fear my friend is going to lose her license and without an intervention, her life (or kill someone else) as she is denial about an obvious problem (.08 feb., .24 and busted C7 2nd one)!

Unfortunately, the Appeals Court of California just this summer (2012) has ruled that a nurse can have her license revoked automatically upon conviction of even her first time DUI offense. The ramifications of this can't be under estimated. It means that you have lost your right to appeal to the BON, in effect- due process has been further eliminated. Naturally, if a license can now be revoked automatically, the chance of GETTING a license from the BON with a DUI has been essentially eliminated. An obvious benefit to the state is that they can drastically reduce the staff in the BON, since revocations will be automatic, eliminating the huge amount of BON staff required to process appeals from the thousands of nurses that receive DUIs every year. But we'll have to wait to see how this ruling becomes either challenged or enforced. (Also, in California- another body had made the determination that a teacher can have his certification (his livelihood) revoked also for a DUI.

Anyone who was convicted of a DUI, did you guys try to fight the charges with the judge/DMV or did you just contest "no contest/guilty" and went on to pay the fines, do the community service and take DUI classes...or whatever the court required

I just graduated in Dec 2012 and have a DUI from 2010 that has been dissmissed by the court earlier this year. I was initially denied but allowed to still take the NCLEX after 3 months of waiting for my denial letter. I took the test but part of the agreement was that I would not know my results until my appeal is dealt with. I took the NCLEX April 4th and haven't heard anything yet. I tried to pierson vue trick and got the good pop up but I'm not sure if that works in my case. So frustrated just waiting... Is there a department at the Attorney General's office that will give updates? The BRN would not give me any information other than to wait... How long did it take to get your stipulated agreement or any contact from the AG?

All that the "good pop-up" means is that you (probably) passed the NCLEX. Unfortunately, all you can do now is to wait to see if the BON will license you. I hope it won't take too long for them to give you an answer one way or the other.

This post is for Sunflw137. I'm in the exact situation. I took my board like 2 weeks after you. I also signed a waiver for the BRN not to release the results. I did the Pearson Vue trick and it took me straight to credit card. Some how I wasn't supposed to find out results but I did anyway. I basically failed. So, I resubmitted my application to the board and my file was already in Endorcement. With the exception they had already sent my case to the general attorney. It's been almost 3 months now and I barely received my respondent letter to appeal. Hopefully from what I was told. The process is pretty fast once you get that letter. The only different is you passed and I didn't. Meaning when your case settle, the BRN will issue you your license and as for me I'll have to retake mine. Hope that help.

Sunflw37 I know its been a while since you posted here but I am currently in the exact same situation.. I took NCLEX, stopped at 76 questions and got a good pop up. I'm wondering if that good pop was in fact "good" for you?.. I'm really freaked out and don't know what to make of it. Let me know how your situation went please. Thanks!

I submitted my application to the BRN the first week of January. Got denied in March but chose to take the NCLEX and not find out my results. I took the NCLEX April 4th. My file was sent to the Attorney General's office mid April. I just last Saturday August 24th received my Statement of Issues from the AG. This is a written case against me from the AG stating that the board had denied me and I am appealing. My choices now are attempt to settle with the board or have an official hearing. From what I have heard it is pointless to schedule a hearing because they are so backlogged that it would not be until next March 2014! Hopefully within the next few weeks I will hear back about an offer from the board to settle.
