Long story short. I am a newly graduated LVN, still have to take NCLEX. When I was in school, I had to write a letter to the BON explaining why I had a hit (or bad mark) on me.

Long story short. I was married for 2 years when I was younger and when we divorced, my wife tried to bankrupt me. She drained our savings account and ran up several high money cash advances on our credit card. I cut her off financially at that time, as she had no way to pay off these huge debts. She got back at me by claiming that I had threatened to kill her and I had to go to the police station where I was booked and released. Now, years later when I am trying to get a job in my field, I find that this has come back to haunt me. Every place that I apply wants a deposition showing that this situation was resolved. No deposition exists. This thing never went to court. We were divorced and that was that.

I did not threaten her. The BON has said that I can take the NCLEX. The only legal papers on file are our divorce papers, and I sent the BON a notorized statement attesting to that fact.

What can I do at this point? Any advice (legal or just common sense) will be greatly appreciated.

Okay, trying to figure this out....Are they finding this on your background check? If you were never charged or charges were dropped then there will be paper work that backs you up.

I'm just not sure how they are finding this out....if it's through a background check or your telling them about it up front. ??

If this was the way it happened and you were never convicted of anything then you shouldn't have anything to worry about.

However, if you were booked into the system, there is a disposition of some sort. Whether that disposition is a conviction, a dismissal, a nolle prosequi, whatever. There is a disposition.

You need to get a copy of a background check on yourself and see what it actually says. Then you will know what to do.

Why would this show on your background check? That is for convictions on misdemeanors or felonies. Are you offering that information?

A "booking" should not be evident. Are you sure you know the ramifications of that event?

All water under the bridge now... if it is hampering your Job Search... you MUST lawyer up.
