hello everyone,i need some advice. if you didnt read my last topic, i was arrested at 18 for petty larceny and was in jail for a few hours, got fingerprinted, and had a mug shot taken. it has weighed heavy on my heart and even more when i decided to change careers and go into nursing. i was SO depressed. i think some of you understand how awful it feels. i just thought i would never become a nurse because of a terribly stupid mistake i made. the judge basically granted a acd (?) and i attended a class and my class was sealed 6 mons later. i decided to do a background check on myself to see if the case was sealed etc etc i just got it back in the mail and it said there was nothing found!!!!!!!!!! no records were found!!!!! i feel like screaming snd crying at the same time. i am so confused and so relieved and grateful...and apprehensive too. do you think the fbi made an error? im thinking maybe ill get fingerprinted again and do it over?? i am so paranoid... also, if this is the case where there is no record of any arrests.. what do i write on my applications for nusing school and such? this is so confusing!!!!thanks everyone for reading!!!

Since your case was "sealed" there is different access based on the company performing the background check. Be thoughtful when filling out applications about your disclosures. Read carefully the applications to nursing school and look now at the requirements by the licensing board in your state. States often require information pertinent to arrests, not just convictions, or convictions regardless of the final disposition. Meaning even if a record was "expunged" or "sealed" you are still required to disclose it. Not every company is going to have the same access, but to be sure, the resources that the state board of licensing and any federal job for which you apply have are vast reaching. Disclosing on future job applications is also a matter of state law.

I am not giving you legal advice here, just advice about character - honesty - and considering the ethics of decisions you make. Many schools take into consideration the time since conviction, the nature of the conviction, and the actions you have taken to rectify your wrongdoing, as well as whether or not the situation would likely occur again. Same with the BON. Before you choose what not to disclose, think about those things. It might be much easier to look past a 7 year old indiscretion, but nearly impossible to look past a current choice to be dishonest. I know how this feels and how heavy a weight it is on your heart, so just be sure to think about the fact that people (even those at nursing school and those at the BON) are not so myopic. My nursing school background check came back "clear" because of the company they used (and my record weren't even expunged). The BON I disclosed and followed all the policies and requirements and had no issues. Don't let your past determine your future.

Please be aware that state government departments responsible for protecting the public = boards of nursing, have different access levels to prior criminal history. Please read info in our thread FAQ: Nursing Licensure With Criminal History prior to completing any license or healthcare emloyment applications.

Follow this advice gathered from varying state boards of nursing and you should be able to receive a license.

More states like PA are requiring FBI, just not state police clearance, if you have not lived within the state for minimum of two years.

I just want to clarify- I got a FBI background check with fingerprints included. Does this differ from a Police background check?

I am really unsure of what to put for my applications at school. I want to put "Yes" under I've been arrested but my mom thinks I'm nuts. She keeps telling me to put NO since no record was found with fingerprints/FBI.

Any advice? I know no one can give me legal advice, but any suggestions or thoughts would be very helpful.

DO U live in new york? Im in the same situation as you right now. I recently graduated from nursing school and im going to apply for my liscence. 5 years ago i was arrested for shoplifting twice and i receieved an acd for both cases. The clerk at court told me at court thay i do no have a record bc there was no conviction. . Do u think i should be on when applying for the liscence. Any luck with getting ur liscence?
