DUI "10 days in jail" on a record!

This is about my husand.

He will finish school and will get an ADN license in March 2011.

He is 38 years old male and has no nurse experience in the past.

We all know that it will be difficult to find a job here (Columbus OHIO)

in this job market for new grads.

Makes matter worse, he has 1 DUI in Jan of 2009.

Anyhow, today we went to a court house to get a criminal record to send to BON for a test.

Yes, his DUI record shows up but also 10 days jail time.

He has never went to jail before. It was option to choose between 10 days in jail or take

a 3day long class. So he took 3day class instead of jail. Court office says they can not correct the info.

Now my concern is about the record of jail time.

Will HR of potential employer see this info? or all they see is DUI info.

Should he hire an lawer and correct this mitake before job hunt?

Hello. Sorry your student nurse husband has experienced a DUI in his past. You wrote that you "went to the court house to get a criminal record to send to the board of nursing for a test". One option to help you learn answers regarding criminal records and potential registered nurses is to call your state board of nursing and ask specific questions. Some "drug" related criminal records of nurses are treated very seriously by boards of nursing. Best wishes!

I don't know anything about this, but it seems to me that if the record is inaccurate, there should be a way to change it. Perhaps he needs to petition the court to have the correct information placed in the record.

1. Do whatever needs to be done to correct the record. It will come up again and again -- and you want the information to be correct. If that means hiring a lawyer, hire a lawyer.

2. He should have copies of something official that says that he could substitute the class for the jail time. He should also have some documentation that he completed the course. He should keep that handy forever and be prepared to submit of it whenever necessary.

I thought it's almost impossible to get hold of BON people.

More than likely the state board probably will contact him. I had the same thing happen and had to get an alcohol evaluation. As long as they give him a positive review he should be fine. If not than they may make him enter into an agreement with the board. I am from another state so I am not sure what ohio board does, but I am pretty sure that they are going to look into it because they are not going to give someone a license if they feel that he has a problem. If you want more info send me a personal message for advice in how to deal with the board good luck!! Oh I did get my license and got a job with the same record as him.
