December 2017 I was pulled over for a OUI got arrested and booked the whole 9. Fast forward to Feb. 13th (TODAY) I was going to go into pretrial and plead guilty for a CWOF (Continuance W/O Finding) but my lawyer (Court Appointed) saw the paper work and he said I have a real good shot at winning because the Breathalyzer result would be thrown out and I was told to recite the alphabet from B-T and I had no issue doing that, and I was asked to count backwards from 83-74 and I missed 77 and repeated 80 twice. When I told my lawyer my intent to plead he pulled me aside and said that even the DA was surprised I'm willing to plead out.
My main concern in all of this is, will a conviction be a more harsh conviction versus a CWOF where it isn't an actual conviction.
I live in Mass as well.
Depending on what the breath result was
If the breathlyzer results will be thrown out, I would go to court. But you didn't clarify why the breathlyzer will be out the game
