Can I have my name taken off a nurse aide abuse registry?

by jw4910

I live in Kentucky. I'm humiliated to even post this. When I was 19 years old I was a CNA; I had planned on going to nursing school and never got around to it. At that time I was accused of nursing home abuse; the allegations were heanious and not true. At any rate, I was given the opportunity to attend an administrative hearing and contest the charges. I was too embarassed at the time and honestly did not realize how serious they were; my name was placed on a Nurse Aide Abuse Registry.

Shortly after I found a great job making more money than I would as a nurse. Our company is on a hiring freeze and everyones job stability is iffy. I would like to be a nurse. I know its not likely to get into a program with these charges hanging over my head, I would like to have them cleared from my name. I was young and stuipid and honestly did not know how big of an impact this would have on my future. What can I do? Any input would be greatly appreciated.

you'll have to contact KBON to find that out. Other than that, cannot give legal advice on this forum. Good luck to you though.

Suggest you seek legal advice from an attorney that has experience dealing with administrative boards. Recommend you contact TAANA (The American Association of Nurse Attorneys) referral service. An attorney with this background will be able to help you through the process. Good luck.

Some ask if you have ever (even if expunged, sealed, charges dropped) been accused. That's where the explanation comes in. You can ask for and submit an appeal with a written explanation. I agree; call the BON first then a Liar (Lawyer). If the BON says no, chances are slim to ever get medicare/medicaid exceptions which means no employment for anyone taking those payors.

It's extremely serious and considered one of the unforgivable offenses listed along with murder.

As above posters have stated, we can't comment on any legal actions and advise you to contact a lawyer.
