Changes to Immigration - page 3

I was told that the immigration laws are changing due to homeland security. I was told that as of July of this year the stipulations are changing and if I don't have a "letter of intent" from a... Read More

You actually could have saved yourself alot of grief and gotten a "fiance" visa.
But congratualtions to you on passing NCLEX and the engagement.
    Good luck to you................
This is an old post, I know, but I thought I'd respond...I could have gotten the fiance visa, but then I'd have to get married within 3 months of entering the country if I remember correctly, and I only got engaged in March and we can't really afford that yet...I really do have to do some more research on other means of immigration, big time.

Oh, and I didn't read what Suzanne4 said earlier all that well...she's right about the leaving for emergency thing...until my visascreen certificate goes through, after July 26th I can't go home, or I won't be allowed back in the country even though I already have my TN. I've got my visascreen half completed, and I don't want to go home, but it's definitely something to consider if you're trying to get into the US before your visascreen completes.

Myself this screen visa is just too much. I'm going to seek to come in as a (Clinical) Systems Analyst forget the visa screen.
What is a clinical systems analyst?

Anything you could tell me would probably be helpful. I'm worried that if I got married, I'd be forced to apply for permanent residency, and my TN Visa would be void while that process was going through. I know another nurse who married an american and now she says she can't go down on a TN because of that. Right now I'm going to use my TN and sit on that until I can find out what I need to do when me and my fiance are preparing to get married, and what that will mean for whether I can work or not. If you know anything and have the time, feel free to PM me. I'd really appreciate anything you might have, even if it's just reliable websites to look up immigration information on.

Yes, I start work in Nebraska on the 12th at the Nebraska Medical Center. I have my TN Visa and I'm licensed for Nebraska. I'm still waiting on my Visascreen, it's in process, about 1/2 done.

If you already have a TN, then you are okay for this year to cross the border, since you are grandfathered in for one year. Just make sure that you get your Visa Screen completed by then.

The immigration officers told me that I could not leave the US, or I would not get back in without the certificate after the 26th of July, even though I have a TN. Maybe they were just being picky, but they told me if I wanted to leave the country after that date I would have to wait for my visascreen to complete before I could come back through even with the TN Visa I have now. As long as I don't leave the US I am ok, but if I leave I won't get back in, they said.

However, if you have other sources that say differently, that'd be awesome. I'm sure my mom would appreciate it. :chuckle Though my visascreen should be done soon anyway, or so CGFNS is telling me.

Supposed to be grandfathered in for the first year if you already have the TN, but peersonally I wouldn't chance it.................
According to the rulings, you have one year to be grandfathered in, go to website for Visa Screen and look at the rulings.

well, that'd be nice, but I'm not going to chance it. If the immigration people are saying that you can't re-enter the country without the visascreen certificate after the 26th, then I'm not leaving the country without that certificate. hehe. They made sure I was aware of that when I was getting my TN, they were like, you know, even with this TN, if you leave the US after the 26th, you can't re-enter without the certificate, so keep that in mind if you travel back to Canada.

You just have to look at your visa for the final say. If it says multiple entry, you're fine.

It does, but they said that that doesn't apply normally after the 26th. They said it's a special case where you won't get back in without both documents. Perhaps I'll call them to clarify.

I would if I were you mushberry. If a visa says multiple entry, that should be the final word. Immigration is not supposed to depend on "well, that guy said" type instructions. It would be a good idea to clarify so they don't screw up any other nurses coming into the country.

Please let me know what they say. I am planning to vacation in Canada the week of the 22nd of July. I won't go if I can't get back in. At present I have a TN good till May 2005.
