Most of my questions have been answered by reading the post and the answers to them. My situation is very similar to many other nurses in recovery. My license was revoke due to narcotics addiction. It started in 2002 when I was cough diverting morphine, entered IPN and after 3 relapses the board revoke my license. They did give me several chances, you know, had to do the psych evaluation, sing a new IPN contract, etc. Then with the license suspended I was arrested at a hospital while attempting to take the wasted morphine from the bio bins at the med room (I was not working as a nurse at the time) This happened in August 2005. With this the board order me to residential rehab. I could not afford it so the license was finally revoked in July 2006. The Board of Clinical Laboratory personnel also revoked all my laboratory licenses. I have been clean since the arrest; I was order to do 18 month of probation for a felony charge of burglary of a structure. After 10 month the probation was terminated by the court. Needless to say I struggle to make a living and after much frustration I was feeling so depress that I was afraid of relapsing or attempting suicide. I thought about going back to school but I owe $10,000 in student loans. I am in the OIG list, so can even get a job in a doctors office and I have a felony so it’s very hard to get any kind of job. In January of 2008, I decided to enter the 1 year free Christian residential recovery program . It was the best decision I ever made in my life. I finish the program in January 2009, and in May they offered me a job as a dispatcher in their donations department. Because I feel so strong in my recovery, I want to go back to nursing. As I said before, most of my questions on what to do have been answered by reading these posts; however I have a couple of unanswered ones that someone may be able to help with.
1. When the Board revoked my license they assessed the cost of the investigation and I owe them $ 9,875.00. Will they even look at my application for licensure while I owe them this money?
2. The final order was to do residential rehab. The program I attended is extremely strict; however, I do not believe they are a state approve rehab. Their counselors are called case workers because they are not license counselors. You see for the most part they are recovering addicts themselves and some of them are also pastors. Will the Board accept this recovery program?

Welcome and good job for your success in recovery!! I am sorry to be giving you bad news here.
From what I know, the fees are the least of your problems in getting reinstated.
I am not a lawyer, but I know some basics on recovery and BON's and OIG.
1. OIG exclusion is mandatory for felonys for 5 year
2. OIG other exclusions that apply for you is permissive due to license loss, both in nursing and clinical labs and your license must be reinstated to be removed.
3/ OIG also excludes for loan defaults so you have a triple whammy with the feds. In many states, the BON also will take action for loan defaults.
Even worse bad news for you and is a HUGE injustice by state law makers and that was snuck into a bill at the last minute and placed into law on 07/09 and is specific is the medicaid fraud bill that prohibits the licensiing of anyone with a felony in the past 15 yrs!!
I have no words of wisdom on how to attack this issue for you... the biggest is the 15 yr state exclusion as far as getting a license.... it does not apply elsewhere so it is possible to move and maybe get a license... but it would take a lot of researching and a good lawyer as well
