I was eligible to sit for the nclex for California.

Wow.. so I took my exam this September, went the distance all 265 questions. Unfortunately I didn't pass. Got my results and "near passing standard" all across the board so the news of failure basically tore me apart.

Now what makes it worse is after submitting the reapplication form and waiting for four weeks for a reply from the board, I get a letter today stating

:::: The Board has determined that the program you completed in the Philippines is not equivalent to the minimum requirements for licensure set forth in California Code Section 1426(d).

You may be able to view Section 1426 (d) and all other codes of the California Code of Regulations by going to our website at: www.rn.ca.gov. Once in the website there will be 'Tabs' at the top of the screen. Go to Regulations then to Nursing Practice Act and finally to California Code of Regulations.

California Code of Regulations Section 1426(d) states that theory and clinical practice shall be concurrent. The documents received state that some of the training was completed several semesters after the theory classes. ::::::

I email the evaluator in charge of my application and she explains ::::

You have options and that is to apply to the LVN Board or in another RN Board in a different state or go for your master's degree in nursing but in California you are not qualified as a RN without the Master's degree.

According to the RLE and the school's curriculum you should have completed the scrubs in NCM 101 and 102 but they were completed in NCM 104, 105 and 103. I am enclosing a copy of the letter that was sent to you yesterday.

I'm angry and sad at the same time. How is it possible that I was eligible to take the nclex the first time I applied and not eligible to retake now? I went from meeting the requirements of an RN to now meeting the requirements of an LVN. How is this possible?

They are saying I'm ineligible based on the dates of completion of my cases. The school requires 5 major, 5 minor, 5 assisted delivery, 5 actual delivery, and 5 cord dressing clinical cases which I completed or else I wouldn't have been able to graduate. All of a sudden Ca board is being technical about the completion dates of these cases. The school is well aware of the fact that completion of these cases is impossible to be concurrent with the theoretical classes. It is not always guaranteed that students will complete the needed cases in concurrent with the theoretical because there are times when there aren't any patients in the hospitals that we are rotated in. It is for this reason that the school allows completion of the needed cases through out the following semesters. We took the theoretical classes before we were allowed to go on our clinicals but the lack of patients made it difficult to complete those 5 cases during that semester. That's why some of my cases were completed one or two semesters after the theory classes.

Am I understanding this correctly? I thought all that matters was that my cases were complete regardless if it was completed in concurrent/along with theoretical or after theoretical. I learned what I was suppose to learn it just so happen that exposure to the actual thing came a semester later.

So now they are saying I can't sit for the nclex in California and I need to complete a masters degree to be qualified as an Rn in California. Is this possible? I went to school graduated with a BSN and in the end I'm told that I only qualify to be a LVN after submitting a reapplication for nclex. .

Clarification would be nice and I would appreciate any advice. This just makes me question if nursing is even the right fit for me cause it's been obstacles after obstacles.

Cassy is right, we have to knock our Universities to let them know what's going on, so in that case our Schools/Universities can address this matter to Commission on Higher Education (Department of Nursing) that to be able to sit for Nclex our cases should be completed on same time manner with the theory (NCM), not only that the number of Hours in every major subject like MS,OB, PSYCH, and so on... so they can do something for those who still studying Nursing in our Country and also for us (hoping) .. in that case there will be no reason for newly grads to suffer like this having a rejection from CABRN... I'm still on the process of Re-apply for NCLEX if they didn't let me i will surely ask for the standard curriculum of CA for Nursing, so i can see what I'am lacking for, and also to present this to my University which i got my BSN degree.. but to enroll those subject that's totally pain in the A**... I would rather apply in other state than to comply with their requirements w/o showing me the real deal... I was able to take my exam last yr w/ a lot of requirements as they requested, and now what?!?! are they calling it rules/policy or should i say MAGIC only for Filipinos? Am i stating it RIGHT?

It's only getting tougher soon, with more US new grads (in CA) getting their degrees soon and with many of their already graduated classmates who are still looking for just their first interview, with some after almost a year of looking and getting their rejection emails or calls.

I know I'm still waiting for my first job offer! I have been on a few interviews and amazing to see 20 applicants in the same room, knowing that they are interviewing 4-5 other sets of people that day for a few days for 2-3 positions, the exact same jobs! Mind you, I have tons of volunteer work, great references, 3.68 overall GPA, BSN.

Some of my own classmates graduated 18 months ago are still unemployed and to qualify for most new grads in CA, you can only apply if you are within 12 months from your graduation date and have from NO to less than one year of RN paid experience.

You can see the irony we face as US CA new grads, we can't get a regular RN job without 1-2 years of experience, but if you have too much time in, your application will get rejected too.

Like in the PH, we too see those ads in the TV and internet ads of the nursing shortages and strong demand for nurses. But these advertisers are playing us since those schools are very expensive as they are more like diploma mills. I went to a regular college unlike some of my friends who went with the pricey easy to get into schools, but hard to get a job as those degrees are a joke.

Oh, I wanted to clarify that to apply for a CA new grad position for the majority of the better known and traditional bedside hospital nursing jobs is 12 months from your school's graduation date, NOT from the time you pass the NCLEX exam.

In many cases of the application process, you need to show on your resume that you also are in possession of your RN license (month and date passed).

So we have the added pressures to apply to all these jobs as quickly as possible, luckily, most hospitals have at least two open application dates within the year's time frame. They do look closely (HR and hiring staff) at your graduation dates, as many of my friends tried anyways to apply after their 12th month, only to get the rejection letter or dreaded notification or no contact at all.

Were all trying to be a RN.. But this rules keep pushing us down.. ?

applied for NCLEX-RN april 2011 and received more and more requirements until the school has sent their last requests regarding these clinical rotations, calendar, class shedules from 1st to 4th yr,student's handbook,etc..and just last week i received a rejection letter.i still don't get it why we're not eligible knowing that others made it..it's really frustating.my two other friends from sam eschool is going through the same situation as well as their friends, should we complain about this?just asking though :)

so how's your application going in NY?planning to move too but hesitant coz they might also consider CABON policy

call or email your analyst if they can transfer your files to BVN,that's what one of the members here told me :)

yes,its my first time and got denied for same reason

that's what im thinking too...i think we should..

Hi to all! I thought I'm alone with this kind of fate. I'm so frustrated and devastated of what happened. Here's my brief background. I arrived here in CA early last year and took and passed my NCLEX from another state. I applied an endorsement here in CA late last year and the same problem I encountered with you guys. Why CA? It's because my hubby is working here from a prestigious hospital and has a position. We went to Sacramento last week to follow up my application but no luck. The same thing. I have to enroll my 30 units deficient in med-surg and ob. My husband and I discussed a lot of options. 1st, if we move out to another state and start all over again but now a days it's hard to find a job. 2nd, to enroll my deficient but it involves a lot of money. And lastly, to take the LVN board. I have a classmate here in CA and applied her NCLEX last 2010 and after a month was approved. She took her NCLEX last year but did not make it. She applied for ATT last month and was approved. She will take again her test hopefully within the month. If she's gonna make it, I wonder if her license will be release. If that's gonna happen, I'm planning to appeal to the BRN. The BRN told me that they will gonna recall all the Philippines graduates from 2004 and up. I do hope and pray the BRN will do something about this and reconsider.

Hi melai12,
