I am considering taking on my school in court and wondered if anyone had information on this sort of thing. I will be suing for unfair dismissal from my first semester in my senior year. My instructor is way out of line and I am getting nowhere with the "powers that be."

First of all, best of luck my friend! I myself had some major problems with one particular prof in my senior year... my nursing studies were running along very smoothly until I had to deal with her. She made my last year of nursing studies HELL but in the end she let me graduate ( as she pu it)... she was on a major power trip with me because I was an older student and came from another to do my last year... I quickly regretted that move! In any case... I won't go into details of the whole sorted afffair with this evil teacher but I would give you this advice: make sure that you have documented in great detail the events that occured between you and this or these teachers.... get lawer.... and be prepared to put all your nursing knowledge at work.

The nurses that were your teachers WILL be considered as experts in the field compared to your student status... their opinion in nursing matters will overshadow much of anything you could say about anything. I might also suggest that you do some reaserch about the teachers that dismissed for no good reason and see if this has happened to others in the past. Can your fellow students corroberate your story... would they testify for you... doing so might put them in conflict with the school and might jeopardise their own studies!

Anyway, I would be much interested in hearing about your in more detail... we could exchange frustrations... although yours must be much greater then mine because I was not dismissed from my faculty....Just now that I understand your anger and frustration.... Write to me anytime if you need moral support!

I was told by the actikng director of my nursing program that I might as well drop out, because she had no intention of graduating any "Silver Spoon" from HER program (it was at a comunity college, and my parents were paying my classes, I was one of 3 NOT on tuition assistance, and one of 2 to graduate, the other worked full time while in school and payed her classes at the onset and got re-embursed by her job at the end of the semester)

2 of my profesors had the same problem with me, but there was nothing about my PERFORMANCE they could do, one gave me an unacceptable for HER half of the semester, but the next clinical Profesor found me to be excellent and put that in my folder, as well as my evaluation, she later gave me a referance for a home health job (which was her specialty, outside of school)

You didn't mention the reason the prof is out of line or why you were being ousted. An attorney could certainly help you get their attention and if any good , he/she should be able to help you determine if you have a good case. Hate to see anyone loose all that time and education. I had a class mate who was to be dismissed our senior year and an atty helped her get her diploma, but she was unable to graduate with us. Good luck.
