What is this retrogression


I am not sure abt this retrogression and how would it affect nurses born in India,who are going to apply afor I140and i148 in next couple of months..
need some insight of the current issue of thsi 50000 visas and all it too confusing.. please help guys

The I-140 and I-485, (assuming you meant I-485 instead of I-148) can only be applied together if the visa category for nurses is current and not in retrogression. A nurse cannot apply for adjustment of status (I-485) if the category is in retrogression. If the category retrogresses (visas run out) by this Oct 2006 as commonly expected, then nurses can no longer go to the US and do adjustment of status. They have to do consular process instead with the accompanying delays.

the thing is that i am in USA now. i have finished all my exams have an emplyer whos all ready to file for me and the only thing i dont have is visa screen.. so can i still apply both 140 and 148 toghteher and submit the visascreen when i get it.. or if i cant apply until i get my visa screen and the quota is full then wat wud be the option..

You need the visa screen for your interview I don't think you can send it after the fact. I would suggest apply for visa screen ASAP

Hi Ms Suzanne,

I am currently in the US. My employer filed my I-140, 485 and EAD (medical exam, visa screen and the attached checks) yesterday. How will retrogression affect my stay in the US? My 6 months stay is valid up to Oct 15.

Will i be able to work if my EAD is approved? I understand that my Adjustment of Status will be delayed when retrogression sets in.

What will be the first document that i will expect to receive from USCIS?
Will they send it to my home address or thru my lawyer?

Is it true that I may not be able to go home until the whole process is over? In between the waiting time, can i avail of an Advance Parole or you wouldnt suggest?

i m gonna send my applicatio tommo.. for sure.. i already mailed BON for verification and told my school to send my transcripts , only need to get the sign of registrar n wait for VSC and mean while i will start work on OPT and see how things goes frm there....its just too confusing...lol.. never give up though... keep fighting..
